Patrick B. Hurley is a Senior Director in the firm’s Litigation Group. Premarital Agreement
If you are already married, there are limited options available to protect “marital” assets from a divorcing spouse. However, if you are not yet married, there are a number of methods that can be employed to protect your assets, including the use of a Pre-Marital or Antenuptial Agreement, appropriately drafted Trust, and asset ownership options. All of these issues should be discussed with an attorney as far in advance of a marriage as possible.There are also effective planning options available to protect your assets from your children’s spouses after your death.
Guardianship
The Huck Bouma Contested Estates and Family Conflicts Group actively practices specialized skill sets relating to disputed or conflicted matters and issues in estates, trusts, fiduciary law, property law and beneficial interests, and guardianships. Estate Planning
We have an active practice in the planning for and preparation of gift tax, estate tax and fiduciary income tax returns. Our experience in all areas of lifetime giving, estate administration, charitable deductions and income tax has provided us with extensive skills in the preparation of these tax returns.
Wills
Will contest: A legal challenge to a Will, usually made by one or more disgruntled heirs. Will contests often are based on allegations that the Will was improperly executed or that the decedent lacked proper mental capacity at the time he or she created the Will or that someone exerted undue influence on the decedent.
Trusts
Third Party Supplemental Needs Trusts are created with the assets of someone other than the disabled person. Similar to a Self-Settled Special Needs Trust, assets held by a properly drafted Third Party Supplemental Needs trust are not deemed available to the beneficiary and, therefore, won’t disqualify the beneficiary from receiving government benefit. The Trust funds can therefore provide a safety net to the disabled individual for his or her lifetime.

Tax Law
We counsel and advise individuals on planning and reporting the use of their lifetime estate and gift tax credit and the generation skipping transfer (GST) tax exemption for the federal gift tax return (Form 709). For many clients with gift or insurance trusts there are annual filing requirements. We also have extensive experience filing federal estate tax returns (Form 706), which is often required during the administration of a trust or estate after death. With the advent of recent tax law changes and the new “portability” rules with respect to the estate and gift tax credit between spouses, it is more important than ever to receive quality legal advice on filing the necessary tax returns after death.
