Jessica regularly represents clients in trial and appellate courts, with a strong track record of winning cases on summary judgment. She has substantial experience litigating in the Western District of Washington and the Ninth Circuit Court of Appeals. Her representation, including as a litigator and a negotiator, is focused on supporting her client’s core business and other objectives. Jessica recently completed a 48-day trial successfully defending a parent wrongly accused of medical child abuse after a secret, two-year investigation by Seattle Children’s Hospital. The rejected allegations were pushed by the head of the child abuse group at Seattle Children’s Hospital whose approach the court found to be “deeply flawed” and to have caused doubts even among the hospital’s own doctors.

Granum Inc., DBA Choice Organic Teas, the First Organic Tea Company in North America, was bought over in 2007, from its original founder/owner, by a group of investors, mainly from India. The company appointed its President/CEO from among the investors which effectively meant outsourcing the Presidentâ€™s job overseas and till the last day, Granum had the unique experience of being run by a non-resident President! This scenario threw up its own set of challenges especially on matters of Corporate Governance, record keeping and related legal matters. Summit Law was brought to our attention through the friendly efforts of Keith Seo, who had just joined the law firm. It gives me pleasure to confirm that all required duties (and beyond) were carried out, over the years, to the absolute satisfaction of the Granum Board and with no hidden costs. We recently entered into a sale agreement, for the assets of the company and this was handled with professionalism by Mark Worthington and his immediate team comprising Laura Harper and Laura Bertin, to name just a few. I believe the costs have been maintained at very reasonable levels. On behalf of the City of Des Moines, defended negligence claims against the city in the Vili Fualaau/Mary Kay Letourneau lawsuit (jury trial); won summary judgment in defense of a wrongful termination/First Amendment claim by a discharged police officer; and defended a breach of contract claim by a former municipal judge.

On behalf of the City of Auburn, led the defense in jury trial involving a false arrest/malicious prosecution claim; defended negligence claims arising from injuries incurred during a riot-training exercise; and defended an age and sex discrimination claim.

In her real estate practice, Michelle has handled thousands of transactions, leases and contracts representing millions of square feet in retail, data center, distribution, logistics, airport, office, manufacturing and other space. Seth Berntsen is a litigator, with a particular focus on employment litigation on behalf of businesses and entities of all sizes. Seth has represented employers in litigation concerning wrongful termination, discrimination, harassment, retaliation, wage and hour, non-competition, and other employment matters. He has considerable experience representing educational institutions, healthcare facilities, and other employers in defense of claims brought by former and current employees. Additionally, Seth has significant experience with advice and litigation over noncompetition agreements and trade secrets. He has also represented commercial clients in contract, tort, product liability, real estate, and personal injury litigation.
Disability Discrimination
Schmitz v. University of Washington et al. (2016-2018). Served as lead trial counsel in defending the University of Washington against claims of disability discrimination, accommodation, harassment, and retaliation brought against the University and in defending three University managers against claims of “aiding and abetting” discrimination. The case proceeded to a nearly month-long jury trial in King County Superior Court in March 2018, resulting in a unanimous defense verdict on all claims in favor of the University and the individual defendants.
