Child Support

Child Custody and Visitation

Spousal Support
Spousal support. Spousal support is support paid by the higher earner to the lower earner. Temporary spousal support is determined by a formula which varies slightly between counties; its purpose is to as much as is practicable, preserve the marital standard of living. Temporary means for the duration of the divorce proceedings, prior to judgment. Permanent support is determined in accordance with a statute specifying the criteria the Court is to use in making that decision. It is “permanent” only in that the term applies to spousal support paid after the judgment is entered. The duration of spousal support varies, depending on the application of one of those criteria, whether the marriage is of long duration (10 years from date of marriage to date of separation) and a complex mixture of factual information that make presenting the case in court part evidence and part presentation. My experience doing this as attorney for the high earner and well as the recipient of spousal support, and doing it in different courts over the last two decades, enables me to better present a client’s argument, whether the mater is to initiate or modify spousal support, in court or with opposing counsel.
Legal Separation
California it passed the first no-fault divorce statute in 1969. The state is a pure no-fault state, meaning that neither spouse needs to assert "cause" when filing for divorce. Instead, couples may divorce if the couple has "irreconcilable differences." There is also a decree of legal separation, which is a divorce in all respects but status- the parties remain married.
Child Abuse
Child custody is a focus of my practice. It came hard but the decision was easy. Just as I commenced practicing my two younger children were abducted. I was, with the assistance and support of the police, the District Attorney, the Federal prosecutor issuing a warrant, the FBI and the immigration police in Mexico, I was able to retrieve them. Once back, I was advised by a police department Sergeant Detective to expect to be accused of child abuse when the Mother returned; she did return and his prediction was accurate. That all occurred in 1992. It etched in my so my practice everything you've ever thought about concerning your children and your participation in fully parenting them and fully participating in their lives. It is for me the ultimate responsibility I have, representing and guiding parents in custody matters, during and after separation and divorce- it is the prime purpose of my practice.

Criminal Defense
As a last enforcement device, the UCCJEA gives prosecutors the power to enforce custody or visitation orders, and law enforcement officers the power to locate a child under instructions from prosecutors. These powers give parents and others who are the victims (along with children) of parental kidnapping the ability to seek help from those who enforce the criminal law. The effect is to provide a complete group of effective remedies.
Restraining Order
Richard reminds me of a southern gentleman and his demeanor in court is convincing and steady. Richard established a cordial relationship with opposing counsel and was a pleasure to work with. He skilfully prevented an unwarranted attempt to obtain a restraining order against me.
Kidnapping
In 1968, the Uniform Law Commissioners promulgated the Uniform Child Custody Jurisdiction Act (UCCJA). The UCCJA was designed to discourage interstate kidnapping of children by their non-custodial parents. Before the UCCJA, it was a common practice for non-custodial parents to take children across state lines. They hoped to find sympathetic courts willing to reverse unfavorable custody orders. In too many cases, they were successful. All the states adopted the Act.
