DUI/DWI

Wrongful Death
A wrongful death claim was filed with the Pike County Court of Common Pleas against Ford Motor Co. – the manufacturer of the pick-up truck. A product liability claim was presented to the jury based upon the legal theory that the airbag system was defective. The Pike County trial judge permitted Ford to present evidence that the pick-up truck driver was not wearing his seat belt at the time of the crash. The jury returned a verdict in favor of the Defendant.
Traffic Violations
The defense contended that the biker was speeding and made an illegal right lane passing manuever. After Attorney Newell had filed a lawsuit and discovery was undertaken, a settlement conference took place. Burglary
On Sept. 4, 2011, Bethlehem PA Police Officers were forced to taser a pit bull while they were investigating a burglary. According to The Morning Call, the cops were called to a home on Philip Street. The police tasered the pit bull and charged its owner with 2 drug related crimes.
Assault
The defendant used a knife to attack the lab which resulted in 18 individual wounds. The dog’s right leg was paralyzed and vet bills were nearly $1,200.00. The defendant plead quilty to an animal cruelty charge and no contest to a simple assault charge.
Homicide
On October 9, 2013, defendant Francis T. Roscioli, Jr. waived his preliminary hearing in Easton regarding multiple criminal charges, including homicide by vehicle. According to The Morning Call, court papers allege that the driver was drunk when he struck and killed a pedestrian walking along Lehigh Drive in Easton PA. The Northampton County District Attorney’s Office is prosecuting the case.
Forgery
Donegal appealed and the PA Superior Court overruled the Trial Court. Once the insurance company received a PA underinsured motorist coverage rejection form bearing both signatures, the burden of proof shifted to the wife. She had to prove that not only was her signature a forgery, but that her husband placed it there without her knowledge and consent. Since she did not present evidence proving that she did not willingly waive underinsured motorist coverage, her UIM claim was denied.
Manslaughter
On June 17, 2011, a Lehigh County driver was charged with involuntary manslaughter, driving under the influence of a controlled substance and other crimes. Investigators recently concluded their analysis of the evidence from a fatal pedestrian-car accident which took place on Nov. 5, 2010 on Race Street in Catasauqua. An article in The Morning Call quotes a police arrest warrant as stating that an accident reconstruction expert determined that a sober driver would have been able to avoid the PA pedestrian accident victim.
Hit and Run
A $139,000.00 settlement for a Stroudsburg, PA uninsured motorist claim took place after a car accident in the Poconos. The victim was driving on Rt. 191 when a car crossed the center line and forced her off the road into an embankment. The hit and run driver fled the scene of the Pennsylvania car crash.

Property Damage
