Mr. Youtz handles civil litigation and class actions of all types. His experience includes securities fraud litigation and arbitration, lawsuits regarding intellectual property and engineering, product liability suits and contract disputes.
Forgery
We have also obtained, for insured lenders: (a) summary judgments under equitable principles, including equitable subrogation; (b) a trial judgment (reversed on appeal) imposing an equitable lien upon failure of deeds of trust due to forgery; and (c) a Court of Appeals decision confirming the priority of a deed of trust lien against a mechanic’s lien claimant. That decision turned on an issue of first impression under Washington’s Mechanic’s Lien Act.

Intellectual Property
We represent individuals and corporations in litigation over intellectual property, including patent, copyright, trademark, false advertising, licensing and trade secret matters. Our clients have ranged from large multi-national corporations to newly formed start-up companies. Our representation is tailored to address the specific goals and needs of the client. We are experienced in seeking and defending TROs and preliminary injunctions over the use of intellectual property

Employment Discrimination
We represent both plaintiffs and defendants in cases that allege employment discrimination on the base of disability, race, age, and gender. See Downey v. Crowley Marine Services, Inc., 236 F.3d 1019 (9th Cir. 2001). We have represented numerous individuals and companies in lawsuits involving non-competition agreements and confidentiality agreements.
Employment Litigation
On graduating law school, Daniel received a Public Service Fellowship Fund grant to head a project housed in Seattle’s Defender Association, advocating for the rights of involuntarily committed patients. Daniel then worked as a staff attorney at the Defender Association, representing adult and juvenile clients in criminal, involuntary commitment, and dependency proceedings. Daniel worked as a staff attorney at the Washington Protection and Advocacy System (now Disability Rights Washington) in federal class actions and investigations of inadequate care for institutionalized individuals. He was also a member of the Public Interest Law Group PLLC, where he represented clients in matters including plaintiff-side employment litigation, Native American rights, appeals from administrative proceedings, and nonprofit formation and governance.

Disability Discrimination
The lawsuits seek injunctive and declaratory relief that would require the health insurers to remove the discriminatory exclusion from their health coverage going forward, and damages that result from Kaiser and Regence’s discrimination. The lawsuits allege that the Affordable Care Act’s non-discrimination provision, Section 1557, found at 42 U.S.C. § 18116 applies disability discrimination protections to certain covered health care entities like Regence and Kaiser.

Bankruptcy
Albina Cases petitioned for the involuntary Chapter 11 bankruptcy of The Aliera Companies, Inc. in the District of Delaware, the same district as the Sharity Bankruptcy, on December 3, 2021. Aliera then filed for voluntary Chapter 11 bankruptcy in the Northern District of Georgia on December 22, 2021. Both parties have moved to have the Bankruptcy Court in the District of Delaware determine the proper venue (location) of the bankruptcies.
