Unfair Competition

Wrongful Termination
Obtained an injunction and favorable settlement for a construction manager/general contractor in the defense of three adversary proceedings in the United States Bankruptcy Court (Eastern District of New York) brought by a debtor-subcontractor. Claims were in excess of $6 million and included claims by a major labor union, as well as claims for wrongful termination and cost impacts by the debtor-subcontractor (delay and inefficiency).

Represent the post-confirmation litigation trust of Novum Pharma LLC, a global specialty pharmaceutical company that owns a portfolio of topical dermatology products in its Chapter 11 bankruptcy proceeding pending in Wilmington, Delaware. Foreclosure
We have advised and guided private equity funds, hedge funds, banks and other lenders in restructuring loans, winding down credit exposures, UCC sales of pledged equity securing mezzanine loans, UCC sales of equipment, consensual mortgage foreclosures, short sales, and conversions of mezzanine debt into equity, and the removal of managing members in preferred equity investments.
