Premarital Agreement
Prenuptial agreements can play a significant role in applying the rules relating to omitted spouses. Specifically, a married couple can in a prenuptial agreement waive their rights to receive property under their spouseâ€™s will or trust. Thus, a prenup can be used to show that the omitted spouse is not entitled to the protections of an omitted spouse; the omission was intentional and was consented to. This is the most straightforward but not the only way in which a prenuptial agreement can be relevant to the potential rights of an omitted spouse or child.
Guardianship
A guardianship is a court case in which the Court appoints a responsible person to (1) take care of a minor child and grants custody of the child to that person, and/or (2) manage the childâ€™s property (called â€œestateâ€ ). Generally, guardianships are for children under 18.

Real Estate Transactions
There are, however, steps that a non-resident alien can take to reduce their estate and gift tax exposure when they own U.S. property. Real estate purchases, for example, can be made in the name of a foreign business entity or a U.S. entity owned by a foreign entity. In such circumstances, estate and gift taxes can be avoided entirely. If U.S. properties have already been purchased in an individual name, it is possible to make changes in title that will avoid or reduce exposure to estate and gift taxes.

Estate Planning
KJMLAW Partners has served international estate planning clients for over twenty-five years. The consequences of organizing a U.S. estate incorrectly can involve hefty and avoidable estate and gift taxes upon the death of the estateâ€™s owner or the transfer of the U.S. estate. This is especially true for non-resident aliens, individuals who are not citizens or residents of the United States, who own property in the U.S. Our firm has advised a wide range of international clients who own real property in the U.S., as well as those who own and operate U.S. businesses with tangible and intangible property.
Wills
Probate Code Section 21610 protects spouses who have not been included in the decedentâ€™s will or trust by providing them a share of the decedentâ€™s community, quasi-community, and separate property. These protections apply when a husband or wife gets married after their spouse signed all of their wills and trusts (sometimes referred to as their â€œtestamentary instrumentsâ€ ), and those documents donâ€™t include the husband or wife. Under these circumstances, California law presumes that the person who created their will or trust would have wanted their surviving spouse to receive property. Trusts

The IRS Form 706, known as an â€œestate tax return,â€ lists all property in an estate, including such assets as bank and retirement account balances, life insurance holdings, and real estate properties. Power of Attorney
A San Marino couple, both aged eighty-five, were selling a four-million-dollar home with no estate plan. The elderly couple presented a risk due to the possibility of wandering away from the facility housing them and losing memory of where to return to. This couple also owned several million dollars in treasury bonds, but the government would not allow power of attorney authority to retitle bonds from the husbandâ€™s name to the title of the trust that was set up. Our team petitioned the court to retitle the estate assets. We represented the coupleâ€™s son (trustee) in drafting an estate plan, implementing it (which required petitioning the court to ensure all assets were moved into the trust created), and obtaining conservatorship.

On behalf of a family-owned business that invested in real estate, obtained leave from a bankruptcy stay. The client had a lien in third position against a commercial property owned by the borrower in bankruptcy. As a result of the lifting of the bankruptcy stay, our client was able to obtain the property through a non-judicial foreclosure.
