Criminal Defense
Since joining Craig & Craig as an Associate in 2004, Mr. Lee has continued to focus on civil defense, family law, and criminal defense.
Wrongful Death
R. Sean Hocking in the Mattoon office of Craig & Craig, LLC recently secured a zero verdict for an emergency room physician resulting from a two week wrongful death, medical malpractice jury trial in Sangamon County, Illinois.
Murder
After completing internships with the Office of the Champaign County State’s Attorney and Land of Lincoln Legal Assistance Foundation, Mr. Lee graduated from the University of Illinois College of Law in 2002. He was an Associate at Dilks, Rodeen & Gibson (Paxton), concentrating his practice on civil litigation, family law, and criminal defense. During this period, Mr. Lee’s defense in a first degree murder trial led the Illinois Supreme Court to substantially broaden the criminal defense of involuntary intoxication. Thereafter, Mr. Lee was an Associate with Sunderland, Spenn, Johnson & Thompson (Watseka) and acted in Assistant Public Defender for Iroquois County while continuing a general civil practice.

Mr. Hocking also devotes some of his practice to Intellectual Property law (IP). A Registered Patent Attorney since 2000, Mr. Hocking has prosecuted patent applications before the United States Patent and Trademark Office (USPTO) to secure the issuance of patents. Mr. Hocking has also represented a variety of clients on matters ranging from claims of trademark and copyright infringement, registration issues, and trade secret issues.

Workers Compensation
The members of the Firm have consistently been honored by their peers, from fellowship in the American College of Trial Lawyers to active participation in the Illinois State Bar Assn., and most notably an active role as officers and board members of the Illinois Association of Defense Trial Counsel. Several members continue to publish regularly with the Illinois Institute of Continuing Legal Education, and produce other professional writings including the definitive resource on the Illinois Workers Compensation Act and the Occupational Disease Act. Employment Discrimination
Mr. Lynch’s primary practice has been the defense of civil litigation in multiple categories of cases, including medical and legal malpractice, products liability, employment discrimination, professional liability claims against realtors and insurance agents, nursing home liability, motor vehicle accidents, premises liability and liquor liability. Mr. Lynch has tried over eighty jury cases in the State Courts of Illinois and in the United States District Court for the Southern District of Illinois. He has handled numerous appeals in the Appellate Court of Illinois, and has also argued appeals in the Illinois Supreme Court and in the United States Court of Appeals for the Seventh Circuit.

Premises Liability
Julie A. Webb, Member in the Mt. Vernon Office of Craig & Craig, LLC, began her career at Craig & Craig in August 1996. Since that time she has practiced in the general areas of litigation with emphasis on medical negligence, personal injury defense, dram shop liability and premises liability. Ms. Webb’s fields of practice also include workers’ compensation and occupational diseases including black lung defense at both the federal and state levels. Ms. Webb is a Court Approved Mediator for the Second Judicial Circuit and has completed 40 hours of family mediation training.

Mr. Hocking also devotes a significant part of his practice to Commercial Transactions and Real Estate Law, where he is experienced in representing clients in commercial real estate transactions, including drafting and preparation of real estate contracts, letters of intent, title review and objection, due diligence, drafting of commercial leases and concomitant business agreements as well as residential real estate matters. Mr. Hocking also represents several local governmental entities in connection with statutory budgeting and tax levy procedures.
Property Damage
Sean Hocking successfully defended The City of Charleston in a three day jury trial ending January 11, 2012, resulting in a zero verdict in favor of the Defendant. The litigation concerned a property damage claim with regard to a building owner that alleged some property damage with regard to some real estate adjacent to where the City had removed and installed a sidewalk. The evidence in the case featured testimony from two structural engineers and a third witness offered as an expert by the Plaintiff whose testimony was successfully stricken during the trial. A settlement offer was made by the Defendant prior to the trial. The Plaintiff never made any response to the settlement offer and never made a demand before the trial.

Kenneth F. Werts joined the law firm of Craig & Craig in October 1984. Mr. Werts’ experience is in personal injury defense with emphasis on workers’ compensation, black lung and occupational disease defense. He is rated AV by Martindale Hubbell and has been selected by his peers as a Leading Lawyer in Illinois. Mr. Werts has written and lectured throughout the State on a variety of topics and is the Co-Author of “Kotecki v. Cyclops Welding Corp. The Unanswered Question,” Third Party Practice, Illinois Institute for Continuing Legal Education, Chapter 8, 2004; Co-Author of “Settlement,” Illinois Civil Practice Before Trial, Illinois Institute for Continuing Legal Education, Chapter 3, 2009; Co-Author of “The IDC Monograph: The Normal Daily Activity Exception to Workers’ Compensation Claims,” IDC Quarterly, Third Quarter 2004, Volume 14, Number 3; and Co-Author of “The IDC Monograph: Economic Disability and Earning Capacity: A Historical Analysis for Wage Differential Claims,” IDC Quarterly, Third Quarter 2006, Volume 16, Number 3. Mr. Werts is a member of the Defense Research Institute. Mr. Werts is also a member of the College of Workers’ Compensation Lawyers and a member of the Illinois Association of Defense Trial Counsel, serving on the Board of Directors from 2001-2006 and as President from 2010-2011.

John L. Barger made a presentation at the Life Span Center for the Coles County Council on Aging on February 24, 2023. The subject of the presentation was basic estate planning. The presentation lasted over two hours with a question and answer session being included. Topics included ownership of assets; the Statute of Descent and Distribution; pre-paid burial plans; Medicaid planning; long-term care insurance; property powers of attorney; health care powers of attorney; DNR orders; beneficiary designations on investments; and the importance of having a will or estate plan in place.

Wills
On August 28, 2015, Greg Ray and Brittany Meeker completed a week long jury trial in Clark County, Illinois, that resulted in a defense verdict in favor of the firm’s client, the Executor of the Estate of Clyde Knowles, rejecting the claims of the petitioners that the probated Will of the deceased was not his valid Last Will and Testament. The Will Contest litigation involved competing claims of the petitioners, who are the daughters of the deceased, and who unsuccessfully sought to probate an earlier Will, which substantially favored them, and their brothers, who are relatively favored in the probated and sustained Will. The determining issue was whether the probated Will was signed as a result of undue influence exerted over the deceased by one or both of the brothers.
Trusts
The Craig & Craig, LLC practice has its focus on civil defense litigation, insurance coverage law, banking and regulatory work, commercial transactions and lease agreements, commercial and residential real property, Trusts and Estates and corporate matters. The Firm also handles employment law matters, intellectual property protection and litigation, and, to a limited extent, family law and criminal defense litigation.
Power of Attorney
John L. Barger and Steven R. Wolke recently made a presentation regarding basic estate planning to seniors at the Cumberland County Life Center.
