Divorce

Child Support
If the Court determines that there has been a knowing violation of a clear Court Order for child support, the Court will issue a Judgment of Contempt which may demand that your ex pay you the outstanding balance or risk incarceration.
Child Custody and Visitation
If a marriage must end, optimally the couple, with the advice and assistance of their respective attorneys, will negotiate the terms of their divorce and submit a Joint Petition to the Court. Sometimes though this isn’t advisable or possible, and a request for divorce (which is called a Complaint) is filed in Court on behalf of one of the spouses. The papers are then served on the other spouse with a Summons. Once a Complaint is filed and an Answer is submitted, the case enters the pretrial period, which will last at least 6 months. Often, the parties will go to Court to seek Temporary Orders as to who will stay in the marital home for the time being, who will pay what bills, temporary child custody/visitation arrangements, temporary support (child/alimony) and other relevant issues that need to be addressed immediately. This does not mean that the parties cannot still reach a mutual settlement of their divorce at any time during this pretrial period or even after.

On March 1, 2012, the Alimony Reform Act of 2011 took effect. The Reform Act provides guidelines, not absolutes, which are being slowly interpreted and enacted by the Court. Generally, the Reform Act classifies post-reform alimony orders into four distinct categories specifically defined in the statute: 1) general term alimony; 2) rehabilitative alimony; 3) reimbursement alimony; and 4) transitional alimony. These classifications are distinguished from one another based on the nature, duration, and amount of the payment.

So, the big question is whether or not you are covered if you do have a Will. The answer is probably yes so long as you have the right language in your Will, nothing has invalidated any portion of your Will (like a subsequent divorce or marriage) and you sign the Will in accordance with the requirements of your particular state. For instance, different states require a different number of witnesses to watch you actually sign your Will! If you don’t do it right – it’s like you never had a Will at all. That’s why you want to leave the “do-it-yourself” kits on the store shelf and forget the forms on the internet – when it comes to the nuts and bolts of putting your Will together, consult with an attorney who does estate planning.

It can be drafted so that the person you name can manage your affairs on your behalf even if you are competent, but just aren’t up to it or available to do so. There are many ways a Power of Attorney can be structured, so be clear with your attorney who is drafting it and make sure things read just the way you want them to. But remember, the best drafted document is only as good as the person who executes it – and that person needs to be up for the job and competent to handle the tasks at hand.
