Wrongful Termination
Both the hiring and dismissal of any employee must be carefully handled to avoid any impressions or allegations of discrimination, retaliation, or wrongful termination. We can work with your company’s recruitment and human resources departments to establish best practices for your hiring process. We can also review planned dismissals and anticipate potential issues.
Employment Discrimination
Mr. Filosa was a law intern in the United States Attorney's Office for the Eastern District of New York, a division of the United States Department of Justice. He conducted research and drafted pleadings concerning to Title VII of the Civil Rights Act, the Age Discrimination in Employment Act (ADEA), and constitutional tort law. He completed an internship with the Nassau County Supreme Court with the Hon. Stephen Bucaria, conducting legal research and drafting orders and opinions.
Employment Contract

Employment Litigation

Non-compete Agreement
Non-compete agreements must be carefully handled, as they are not enforceable in some states. In others, these contracts are enforceable but must be carefully drafted to remain reasonable in scope. Severance Agreement
Representing a publisher client that underwent a major reorganization effort that impacted employees throughout the United States. This reorganization involved various reductions in their workforce. We provided advice and prepared documentation relating to the reorganization, including guiding them on federal and state WARN Act notification issues, reduction in workforce issues, severance agreements, benefit continuations, releases of claims, and compliance with wage and hours laws. Our team worked closely with the client’s legal, human resources, and payroll departments to ensure the orderly handling of the reorganization from start to finish.

Further, Mr. Sacco assisted the law clerks with initial drafts of orders on motions.

Estate Planning
Lee's practices include a wide variety of commercial and real estate litigation. He appears regularly in the State and Federal Courts. He has also had considerable success handling appeals. Lee has represented large financial institutions, regional banks, insurance companies, hospitals, contractors, a diverse assortment of large and small businesses, as well as individuals. Lee also serves as corporate counsel to several clients assisting in the review and negotiation of contracts and leases and providing advice on a variety of issues as they arise in the course of his clients' business.

Foreclosure
Lee is a graduate of the University of Wisconsin-Madison and New York Law School. During law school Lee held internships with the Criminal Prosecutions Bureau of the Office of the New York State Attorney General and the Hon. Budd G. Goodman, Justice of the Supreme Court of the State of New York in Manhattan. Upon graduation, Lee had the privilege of serving as law clerk to the Hon. Garry S. Rothstadt, a Judge of the Superior Court of New Jersey, currently sitting in the Appellate Division. Following his clerkship, Lee worked in Manhattan for several years with the firms of Martin, Clearwater & Bell, P.C., Himmel & Bernstein, P.C. and Maloof Lebowitz Connahan & Oleske, P.C. Lee has served as a small claims arbitrator in New York City Civil Court and has volunteered to provide assistance in the Nassau County Bar Association Mortgage Foreclosure Clinic and in the New York City Civil Court Consumer Debt Clinic. He has also served as a judge for the New York State High School Mock Trial Competition.
Tax Law
Appellate Law. Our appellate practice group represents both appellants and respondents in judicial appeals. We routinely work directly with our own litigators as well as trial lawyers from other firms. Our appellate attorneys have appeared before the United States Supreme Court, the New York State Court of Appeals, and the New York State Supreme Court, Appellate Division and have successfully helped clients appeal cases involving real estate conflicts, tax issues, business disputes, and environmental issues.
