Guardianship
Through a guardianship proceeding, a person can seek the appointment of a Guardian for the personal needs and/or property management of another person who can no longer make decisions for themselves. While these matters most frequently relate to meeting the needs of the elderly, in many instances it is necessary to seek the appointment of a Guardian for young adults.

Forgery
There are various different ways in which estates wind up in litigation. Contests often arise with respect to the validity of a Will. Most commonly, this litigation is based on the allegation that a Will is either the product of undue influence or coercion or that it is an outright forgery, that it was revoked by the execution of a new Will or other act of the Testator, or that the Will was never properly executed in the first place thus rendering it invalid.

Medicaid Planning
Medicaid planning exists because Medicaid is what is known as a “means-tested” governmental program. Specifically, for the year 2015, an individual is only entitled to receive nursing home Medicaid if there is under $14,850 titled in his/her name. The idea of losing all of one’s hard-earned assets collected over a lifetime of earning and saving in a mere matter of a handful of years to the costs of maintaining that person in a nursing home is something that people generally wish to avoid, if at all possible.

Estate Planning
Many people blessed with the ability to do so desire to retain as much of their accumulated wealth as possible within their family upon their death. Among other goals, people commonly desire to avoid, to the extent possible, taxes and estate administration fees (e.g., probate or administration expenses). Wills
After a person’s death, in order for their wishes and testamentary designs set forth in their Last Will and Testament to become operative, their Last Will must be probated with the Surrogate’s Court. “Probating” a Last Will refers to the process of having it declared valid in the Surrogate’s Court and obtaining the appointment of an Executor to administer the Estate. In order to successfully probate a Last Will, a proper Petition for Probate must be filed with the Surrogate’s Court. Frequently, disputes arise in the probate process based upon allegations of some flaw in the Law Will or the process through which it was executed, resulting in the filing of objections against the probating of a Will.
