DUI/DWI
According to a New York Times study, New Jersey has some of the toughest laws in the Nation. [1] According to that same study, if a conviction is obtained New Jersey has some of the harshest penalties in the country. For example, unlike most states, like New York, New Jersey does not limited work driving licenses during the period of time of a DWI suspension.
Traffic Violations

Sex Crimes
A new law in New Jersey increases penalties for many sex crimes in New Jersey which was signed by the Governor this week. A summary, but not complete list of the new law is as follows.
Fraud
Attorney Results: Recently in Essex County Superior Court I was successful in gaining the admission of my client who was indicted for second degree arson, second degree insurance fraud, and third degree theft by deception. The defendant a registered alien would have been deported if he took any plea to any of the charges. In this case a plea of probation was offered to a plea of a fourth degree charge of filing a false police report. After the third trial call, the prosecutor obtained approval of my client's admittance into the program, in which all the charges will be dismissed after one year.
Robbery

Burglary
In fact, in one particular case in which Attorney Sanzone handled in Ocean County, the Ocean County Prosecutor did such a thing. In this case the defendant was charged with burglary. A witness at the scene (an employee of the suspect/defendant) told the police at the scene that his employer (suspect/defendant) did not enter the house. Not satisfied with the witnesses’ response, and animosity toward the suspect, the Toms River police on the scene told the witnesses that if he did not give an official sworn statement that the suspect/defendant entered the house that the witness would be arrested as an accomplice. Afraid the witness went to police headquarters and gave a sworn statement saying that his employer entered the house. A few days later, the witness having remorse that he allowed the police to intimate him in lying for the police, wrote a certified letter to the police chief stating that he wanted to retract his statement, was intimated at the scene and wanted to give a truthful statement that in fact his employer did not enter the house. A week later not having heard a response the witness sent another letter. A week later the two detectives from the Toms River Police Department appeared at his home around 11:30 P.M. without notice. Angry, the two detectives again threatened the witness telling him to if he did not stick to his original story that the witness would be arrested for filing a false police report. If that was not enough the police told the witness to say that his employer/defendant told him to write the retraction letter, and if the witness did not he would be arrested. Unfortunately, for the two detectives, the witness had audio recorded the detectives suborning perjury, committing official misconduct, and engaging themselves in witnesses tampering. The defendant a few days later sent a copy of the audio tape to the Toms River Police Department and Ocean County Prosecutor’s Office.
Theft
Misdemeanors
Although the park police will not fine or arrest nude bathers, most visitors of that beach do not know, or fully understand, that the federal park service which enforces the laws at that beach have a zero tolerance for behavior which would constitute a federal crime or misdemeanor. Such behavior would be touching of one’s self or someone else in a sexual manner, or other lewd or indecent conduct. In some cases this alleged touching could be misinterpreted by an observer (park police) of this alleged conduct.
Drug Crimes
In New Jersey the Comprehensive Drug Reform Act of 1987â€, codified under N.J.S.A. 2C:35-1, is the most difficult and comprehensive and confusing of all the criminal statues codified under Title 2C. In addition, the case law which interprets Title 35 is likewise difficult and comprehensive and therefore in order for a criminal attorney to intelligently and vigorously represent an individual charged with a Title 35 drug offense the NJ criminal defense attorney must have four things to successfully represent an individual charged with drug offenses. First, the attorney must have knowledge of the law; second, experience in applying that law in any given situation; third, trial experience if the matter ultimately goes to trial; and, fourth, the attorney to think outside the box, using his creative skills, to pull-the-rabbit out of the hat and figure out really what happened in the case, and develop and pursue all of the viable defenses for the defendant.
Assault
Superior Court of New Jersey-Hudson County. Defendant indicted for 1st degree kidnapping, 2nd degree aggravated assault and extortion, 3rd degree false imprisonment, 3rd criminal restraint, 3rd degree extortion, 3rd terroristic threats. Before the start of the first trial judge threw out extortion count. However, a mistrial was declared when jury could not reach a verdict as to the counts of the indictment. Two months later, second jury trial and jury found defendant not guilty of 1st degree kidnapping, not guilty of 2nd degree aggravated assault, not guilty of 3rd degree criminal restraint, not guilty of terroristic threats, not guilty of false imprisonment. Jury deadlocked on lesser included charge of 3rd degree aggravated assault and disorderly person's offense of harassment. Client faces minimal jail time of 20 years on the kidnapping charge alone. After verdict and discharge of jury, defendant not wanting to face the possibility of a third trial, plead guilty to 3rd degree assault, and a sentence of time served since he spent 10 months in the Hudson County jail waiting for his second trial under pretrial detention. Defendant released the same day.
Murder
Likewise, an actor who sets a fire or explosion that causes death be guilty of felony murder, a first degree crime (10 to 20 years state prison sentence). Felony murder with arson could occur when the actor puts someone on fire or a structure in which someone dies, including a firefighter.
Arson
N.J. S.A. 2C:17-1(a), the crime of aggravated arson is a classified as a second degree crime (state prison sentence of 5 to 10 years) if the actor starts a fire, on his own property or of another’s, or causes an explosion under the following circumstances.
Shoplifting
Shoplifting charge is a serious charge and can have serious consequences on one's present or future job prospects.
