Traffic Violations
Texas speeding regulations place additional restrictions on school buses. While cars, motorcycles, and light trucks can travel at 70 mph during the day, school buses are limited to just 60 mph if they have passed a commercial motor vehicle inspection, and only 50 mph if they have not. Texas law also requires approaching drivers to stop when the school bus stops to pick up or drop off passengers and to remain stopped until the bus driver turns off the stop signals.
Homicide
Wrongful death refers to the untimely termination of life caused by the negligent or intentional act of another. The wrongful conduct leading to the death can be criminal, as in cases of homicide, or “accidental,” but having the same result. Intoxicated drivers, for example, might not have the intent to injure other motorists, but can do so anyway with their reckless behavior. Employers are similarly not in the business of killing their workers, but are nevertheless liable for preventable, work-related fatalities.
Hit and Run
Under Texas law, liability for car accidents is premised upon general principles of negligence and Statutory law. Drivers have a duty to safely operate their motor vehicles. Those who breach that duty are liable for injuries arising out of the accident. The Texas Transportation Code sets forth “Rules of the Road” governing the conduct of drivers in accidents resulting in personal injury or death. Pursuant to Section 550.021 of this Code, operators of motor vehicles involved in such accidents must immediately stop their vehicles at the scene of the accident and comply with their duty to “give information and render aid.” This means providing “reasonable assistance” to any injured party, including transportation to, or making arrangements for, medical treatment. According to these laws, a “hit and run” from accidents involving serious bodily injury or death is a criminal offense punishable by fines, imprisonment, or both.

The Civil Practice & Remedies Code defines a products liability action as any action against a manufacturer or seller for recovery of damages arising out of personal injury, death, or property damage caused by a defective product. To show a design defect, claimants must prove that there was a safer alternative design that would have prevented or “significantly reduced” the risk of personal injury or death.
