A GOOD DIVORCE

Steven Ahby helped me enormously during a tough time and gut wrenching divorce. His advise was sound and time tested. Five years after the divorce my ex threatened to drag me into court to undo part of the settlement. The job Steve did was so thorough the threats faded with the facts. Child Support
Sadly, it is not unusual for a parent to fall behind in child support obligations after a divorce is finalized. Since child support is a financial lifeline for children, falling behind is never a good thing. When Steve Ashby represents the party receiving child support, he works efficiently to restore the payment of child support and the arrearages that have built up. Sometimes, this can be accomplished by working with the party paying child support, to avoid the expense of going to court. When that is not possible, Steve takes sure and swift measures to get child support flowing again. To accomplish this, Steve can seek to have support paid through direct deduction from a paycheck or have the wages garnished from paychecks (a different process) or bank accounts. Ultimately, the court has the power to place a delinquent parent in jail until a specified child support arrearage is paid.
Child Custody and Visitation
In many cases, parents can and do resolve the questions concerning custody and visitation by referring to prevailing norms and customs. When those norms don’t work for both parties, schedules and practices can be adjusted to fit each family. Guardianship
Sometimes the greatest problems are the result of disability, not death. If a person becomes incapacitated, those who have to care for them are forced to go through a cumbersome and expensive Guardianship and Conservatorship process. In the vast majority of cases, this process can be avoided by signing a Durable Power of Attorney before someone becomes incapacitated. Similarly, if you become incapacitated and are unable to make medical decisions for yourself, an Advanced Directive for Healthcare can be used to appoint a trusted advocate to make those decisions for you. The Advanced Directive can even be used for important end of life decisions when you can’t speak for yourself.

Wrongful Death
Nothing is more devastating to a family than a death or injury resulting from the negligence of others. Automobile accidents, equipment malfunctions and defective products can produce more misery and financial devastation than any disease. When a family member is a victim of such a mishap, the first thing people want is answers to their questions. Who caused this injury? Was it preventable? How can we ever get back to where we were before the injury?

Personal Injury
What will all of this cost? In any personal injury case, the client can elect to have attorneys’ fees calculated from a percentage of any judgment or settlement in the case, rather than be charged an hourly fee. If there is no recovery, then no attorneys’ fees will be charged. This is called a contingency fee. The percentage (or contingency) charged would depend on the anticipated length and complexity of the case. Typically, the contingency rate runs from 33% to 45%, depending on all of the factors. As part of this arrangement, the client is ultimately responsible for any out of pocket costs for the case, such as filing fees and expert witnesses. If the attorney pays these costs, they will be deducted from any recovery after the case is over.
