DUI/DWI

Fraud

A jury began deliberating Thursday whether a well-known Harbor Area softball coach is guilty of molesting teenage girl athletes. During some five hours of closing statements, Deputy District Attorney Robert Hight and defense attorneys Robert Ernenwein and Nancy Kardon painted starkly contrasting portraits of Marco Espinoza, 59, who is on trial for six felony and four misdemeanor counts of inappropriate touching. One charge involves fondling an adult.

Assault
By definition, assault is an attempt to inflict physical harm or injury; battery involves touching a person in a damaging or offensive manner. The punishments for assault and battery can range from a hefty fine to prison time. Juvenile Crimes
Juvenile crimes include misdemeanor and felony-charged crimes committed by a person under age 18. In some cases, a juvenile may be charged as an adult if the crime is a felony. Most juvenile crime sentences are less severe than adult crime sentences.
Homicide
A forensic psychologist and a retired homicide detective testified that the Los Angeles police investigation was inadequate, noting the interviews with the teenagers should have been recorded, and that books given to the 16-year-old could have encouraged false allegations. Espinoza himself also testified, denying the charges. Espinoza’s family and friends filled the aisles of one side of the courtroom Thursday. Son Jesse Espinoza said that the one-year insvestigation and trial has been a “living hell” for his family, but he does not wish harm or revenge on anyone. “God will make that decision,” he said. “The people I am most upset with are the parents." Some of them were at all the games and practices where some of these allegations supposedly took place. Some of them took place in 2003.
Arson
Arson is the crime of maliciously, voluntarily and willfully setting fire to the building, buildings, or other property of another or of burning one's own property for an improper purpose, such as to collect insurance. Arson is a very serious offense, and is often charged as a Federal crime, a conviction for which results in a mandatory minimum five-year Federal prison sentence.

Part of her commitment to criminal defense was born out of her extensive time spent on the other side of the courtroom. Prior to working on behalf of defendants, Nancy spent eleven years as a federal prosecutor in the United States Attorney’s Office. During that time, Nancy prosecuted a broad range of offenses, including violent crimes (murder for hire, threats to kill, arson and kidnapping), large-scale drug trafficking, child exploitation, international contraband and human smuggling, fraud, computer crimes and immigration abuses. She wrote and argued numerous appeals before the Ninth Circuit Court of Appeals and her work on a landmark federal case earned her a nomination for a United States Attorney General’s Award for Excellence in Prosecution. Also during her tenure as a prosecutor, Nancy was assigned to coordinate all prosecutions under the Violence Against Women’s Act, which included multiple lectures presented to law enforcement agencies and to local, state and federal prosecuting agencies about guns and violence. After 9/11, she began working on the Terrorist First Response Task Force, as the Chief Information Officer at the Central District of California Command Center.

Nancy began her legal career in labor and employment law, working as an associate with the venerable international law firm Paul Hastings. It was her success in federal court during this period – winning or successfully negotiating settlement deals on all of her federal discrimination cases – that first drew her to the federal system and, ultimately, to the United States Attorney’s Office.

After graduating with honors and a double degree in Classical Studies (Latin and Greek) and Italian, Nancy headed west to study law at UCLA. After her first year in law school, she worked as a summer clerk for the prestigious Los Angeles firm Hughes, Hubbard and Reed. During her second year, she worked as a clerk for the late honorable United States District Court Judge William Matthew Byrne, Jr., and the summer after her second year led to an internship at the office of Paul Hastings, Janofsky and Walker – one of the premier employment discrimination law firms in the nation.
