Mutual Funds
Looking at the Unisys plan as a whole in the context of plaintiffs’ allegations, the court was unable to infer from what is alleged that the its investment selection process was flawed. The appellate court agreed with the district court that the Unisys plan contains a variety of investment options including company stock, commingled funds, and mutual funds (see “Unisys, Fidelity Win Excessive Fee Case Dismissal”). As of the filing of the second amended complaint, the plan contained 73 distinct investment options. Among the retail mutual funds specifically targeted in the complaint were funds with a variety of risk and fee profiles, including low-risk and low-fee options, according to the opinion.
Wealth Management
Josh Itzoe, partner and managing director of Greenspring Wealth Management in Towson, Maryland, works on a flat-fee arrangement. Although his firm does have the option of working on basis points if that’s what a client prefers, Itzoe cannot recall the last time one preferred this. “We made the move a couple of years ago based on advice from our ERISA (Employee Retirement Income Security Act) attorney,” he explains, adding that Greenspring charges separately for plan-level services versus participant-level services.
Money Market Funds
The initial complaint was filed September 11, 2006. Plaintiffs alleged that Lockheed Martin breached its fiduciary duties under the Employee Retirement Income Security Act (ERISA) when it imprudently managed and invested plan participants’ retirement savings in funds that charged excessively high fees that diminished returns. Further, they alleged that Lockheed Martin allowed an unreasonably high level of participants’ retirement assets to be held in low-yielding money market funds of State Street Bank & Trust, with whom Lockheed Martin had multiple business relationships. The plaintiffs also alleged that they were charged excessive recordkeeping fees.

Financial Planning

Congress and the government agencies are visited by anti-fiduciary advocates more than 20 times the visits seen by pro-fiduciary advocates. Wall Street’s investment banks have committed to each other to spend hundreds of millions of dollars, if that is what it takes, to defeat the application of the fiduciary standard to the investment advisory activities of broker-dealers.”
Retirement Planning
The proposed rule was unveiled today by the Department of Labor (DoL), which noted that its adoption “would protect beneficiaries of pension plans and individual retirement accounts by more broadly defining the circumstances under which a person is considered to be a ‘fiduciary’ by reason of giving investment advice to an employee benefit plan or a plan’s participants.”
