Criminal Defense
Katie focuses her practice on civil litigation. She graduated from Gonzaga University School of Law in 2015. While at Gonzaga, she interned with the Spokane Public Defender’s Office representing children in need of services. Following law school, Katie’s practice involved criminal defense and representing clients on both sides of civil litigation. Prior to joining Kirkpatrick & Startzel, Katie was an Assistant Attorney General for the State of Washington where she defended the State in civil litigation cases. She has litigated cases in both state and federal courts as well as the court of appeals.
Wrongful Death
Recently, Washington State’s legislature considered making changes to Washington’s wrongful death statutes which could have significant impact on the recovery by family members. Currently the statutes limit recovery to certain family members. Recovery is allowed to spouses and children of the deceased for economic and non-economic damages. However, if the deceased did not have a spouse or children, then the parents or siblings could recover but only if they were “financially dependent” on the deceased. The parents or siblings did not have to be completely dependent, but there had to be a showing of at least “substantial” dependency.
Misdemeanors
After graduation, he worked at the Grant County Public Defender’s Office in Ephrata, Washington where he tried numerous misdemeanor cases. In 2016, he accepted a position at the Spokane County Public Defender’s office, representing individuals charged with misdemeanor and felony criminal offenses. He tried several felony jury trials during his tenure with the office.

Paul is a founding member of Kirkpatrick & Startzel, P.S. with over 35 years of litigation experience. Paul has represented clients in Washington, Idaho, and Montana in litigation matters related to personal injury, product liability, employment law, insurance law, veterinary law, and insurance defense litigation. Paul has also represented municipalities on cases involving alleged civil rights violations, road design issues, police and jail procedures, inverse condemnation claims and employment disputes. In addition to his legal practice, Paul has been a successful mediator for over 10 years. He has mediated a wide variety of cases including cases involving personal injury, business disputes, employment disputes and product liability claims.

Premises Liability
Todd R. Startzel has over 30 years of litigation experience. His active litigation practice focuses primarily on areas of insurance defense, construction defect, product liability and multi-party complex litigation. Mr. Startzel’s diverse litigation experience spans a breadth of claims from defending manufacturers of consumer products and food contamination cases to defending motor vehicle drivers of both passenger and commercial vehicles. These cases range from, among many, personal catastrophic injury to wrongful death and traumatic brain injury, as well as defending landowners in a vast array of premises liability cases, such as slip and falls, over-service of alcohol, timber trespass, defamation and civil rights cases. Mr. Startzel has tried to verdict 48 civil jury trials in Washington and Idaho. He has also argued over 30 appellate cases in both Washington and federal courts.
Construction Litigation

Medical Malpractice
Ms. Dragoo’s presentation focused on the presentation of lay and expert witness testimony in court proceedings, as well as the use of expert reports. The effective presentation of testimony from a qualified expert witness is often critical to success in court proceedings. Some claims, such as medical malpractice or product liability, may require expert testimony as a matter of course. Proving damages often involves expert witness testimony as well. Ms. Dragoo discussed critical aspects of qualifying or disqualifying expert witness testimony in state and federal court.

Wills
Estate of Rathbone, 412 P.3d 1283 (Wa. 2018). In that case, Ms. Rathbone named her three sons as residuary beneficiaries in her Last Will and Testament. One of her sons was named as her Personal Representative. The Will further indicated the Personal Representative would have non-intervention powers.
