Traffic Violations
Or may not issue a traffic ticket. It's extremely important for you to call an attorney regardless of the outcome of this investigation and here's why. Believe or not, in Florida whether a person receives or does not receive a traffic ticket as result of a motor vehicle crash is not admissible in court.

A daily question we hear in my office is regarding damage to a person’s automobile from an auto accident. Clients worry the insurance company will not repair their car to the same condition it was prior to the accident. This is of special concern when the client is driving a fairly new car. I usually have to discuss with them the whole procedure of how to handle the property damage claim.

If you live in Florida, or spend enough time here, you will no doubt have heard the term “no-fault state,” but you may not realize what that means. It means YOU are responsible for your medical treatment regardless of who is at fault. Again, YOU, not the other driver, are responsible for the payment of your medical bills and any lost wages you suffer as a result of someone else’s negligence. This is why everyone who buys a Florida auto insurance policy is required to carry Personal Injury Protection (PIP) coverage. Minimum PIP pays for $10,000.00 of emergency medical treatment for injuries from a car crash so long as you visit a qualified doctor within 14 days of the crash. However, PIP only pays 80% of the bill, and once it has been used up, there is no more money to pay for remaining medical treatment. The remaining amounts are your responsibility.

As for credit cards? It works in the same general manner. A debt collection agency may tell you, in fact you may know, the deceased had substantial credit card debts when they passed. You are not responsible to pay any credit card bills of the deceased unless you are an approved user of the credit card. Debt collectors often work for credit card companies calling you to make those payments and offering to help you by setting up monthly payments to pay the debt. Don’t do so!
