The victims of drunk driving receive more protection in Connecticut than they do in some other states. Our state allows DUI victims to sue those who provided the alcohol if it can be shown that the person they served was already visibly drunk and that such a sale contributed to the cause of the accident. Traffic Violations
It is not uncommon in motorcycle crash litigation for the defendant’s attorney to dispute the liability of their client. Defense lawyers often claim that the motorcycle rider was driving recklessly and was wholly or partially at fault for the accident. Through the discovery process, evidence may be gathered to refute these arguments and establish the defendant’s liability. For example, if a motorcycle rider changes lanes without signaling and is hit by a car, it may initially appear that the rider was completely at fault. Using the discovery process, the rider’s attorney requests the driver’s phone records and learns that the driver of the car was texting at the time of the crash. The lawyer also requests the driver’s GPS information recorded by his vehicle, which shows that he was speeding when the incident happened. Armed with this evidence, an accident reconstructionist can show that, if the driver had been paying attention and driving within the speed limit, he would have had plenty of time to slow down and avoid hitting the rider. Such evidence may result in the rider being able to recover a portion of their damages under Connecticut’s comparative fault laws. It is important to remember that how the jury will rule in any given matter is always going to depend on the specific facts of the case.
Hit and Run
Connecticut law requires all insurance policies to have uninsured/underinsured provisions which protect a driver from those with inadequate coverage. Every policy is required to provide a minimum of $25,000 of coverage, per person, for cases involving the negligence of another driver. This means that if a defendant causes an accident and their insurance will not cover all of a victim’s damages, then the victim may make a claim against their own policy for the remainder. This coverage is especially helpful in cases involving a hit and run or an uninsured defendant.

Premises Liability

Trusts
A living trust is created through the drafting and execution of a “declaration of trust.” An individual may administer their own trust throughout their lifetime. The trust may be set up in a way where the property will automatically be distributed to the beneficiaries after the grantor passes. The instrument can also be set up in a way which allows for a “successor trustee” to oversee the trust and to only distribute the assets after certain requirements have been met by the beneficiaries (such as a condition that one not inherit until they graduate from college).
