I'm still in college. $1,255.00 is way too much money for me to spend on a apartment. No bedroom. Carpet. I hate carpet. It gets dirty and gets fleas. Plus: They want to rob you here. $200.00 hold fee. $35. Back ground check. Then a questionable : $496.00 pro rate fee. I found a room to rent. For : $300.00 a month. This is good for me. Seems like a very big scam. The female African American adult manager does not look you in the eye. I have a problem with that . Over priced. Bad customer service.

We came here on one occasion. The female African American adult, property manager puts her head down allot. She avoids eye contact. That sends very bad vibes. She wanted us to leave a hold on a apartment we could not even see. Does this make any sense? The amount she demanded was: $200.00. Then she demanded : $35.00 for a back ground check. We asked if we could have a licensed investigator do the check then mail the results. She looked angry. In regards to apartments it good to know some relevant codes: Like : Calif. Civil Code: 1940.2 Under what is unlawful for what a landlord can do. For the purpose of influencing a tenant to vacate a dwelling. Then we have: Government Code: 12955 Fair Employment and Housing Act. Plus: Calif. Civil Code. 789.3. Calif. Penal Code: 518. Extortion. As we know its illegal for the owner of any housing accommodation to discriminate against or harass any person because of the race , color, religion, sex, sexual orientation , marital status, national origin , ancestry , familiar status , source of income , or disability of that person. There is what is recognized as: Harassment Protection For Tenants. Under Calif State Law. I found reading all the books on: Nolo. Tenant Rights . Very helpful. Plus: The ( PDF ) Harassment Protection For Tenants Under Calif Law.

The ten examples of: Landlord Harassment. ( 1.) Failing to perform maintence tasks in a timely and responsible manner. ( 2.) Withholding amenities that were previously allowed, such as pool privileges or landscaping services. ( 3.) Notices of improper conduct that are made up or exaggerated. ( 4.) Notices of improper conduct that single out the tenant while violations from other tenants are ignored. ( 5.) Refusing to accept or otherwise acknowledge proper payment of rent. ( 6.) Entering the property with out just cause or proper notice, often repeatedly. ( 7.) Creating a nuisance : Like loud noise or throwing trash). That disrupts the tenant's ability to quietly enjoy the rental unit. ( 8.) Deliberate destruction of tenant's property. ( 9.) Threats of financial injury, such as reporting to a credit bureau or refusing to provide positive references to future landlords. ( 10.) Physical intimidation and threats of physical violence. Can we agree : All various forms of harassment are against public policy? Calif. Gov. Code: 12900. Or even keeping a tenant in the dark of something they need to know. Silence of a entity, based on time of discovery. Calif. Gov. Codes: 911.23 & 911.64. Can sharing personal and private information to a third party be a form of hazing, brow beating and harassment ? What would be the motive and intent? Could it be : Intimidation and control? Sure we have writers that do expound of apartment tenant harassment. Like: Ms. Jenna Marie. https://homeguides.sfgate.com/can-apartment-manager-harass-me-53050.html. Plus: Calif. Department of Consumer Affairs. Calif. Tenant. Yet is this enough? In labor law we have: Constructive Discharge. Calif. Labor Code: 2922. When the employer makes the life of employee so miserable the average employee will quit. This is what the employer wants. Why? So the employer does not have to pay the employee : Unemployment insurance. In apartments we have: Constructive Eviction. Same thing. The property manager orchestrates situations to cause the tenant to be over whelmed then to leave. Can: Calif. Civil Code: 1940.2 ( c) be applicable ? We have the scenario of a new tenant . Not being allowed to see the apartment. Yet, the property manager could have made a scheduled appointment to view the apartment if occupied. Was this done? Answer no. Was the new tenant required to pay money prior to seeing the apartment? The answer is : Yes. $35.00. For criminal back ground check. Plus: Credit history. New tenant told not refundable ? Next: New tenant was : Required to pay: $200.00 hold fee. Next: New tenant was informed he would be properly shown how to set up automatic deduction payment. Did this occur? Not exactly immediately. The new tenant was first required to pay the first and last. The amount was: $1455.00. Prior to the new tenant arriving to the leasing office repeatedly over and over the new tenant asked office staff and property manager about more money required to pay: $496.00 pro rate. The reason for this to be paid. " Don't worry it will be deducted". Note: Is this a answer? New tenant not informed day prior of other required info to have, prior to setting up automatic payment: Electric company and gas company account number. No email day prior. This technique is called: ( Sand bagging ). Next: In a hostile fashion: Female African American adult refused to allow the new tenant access to leasing office internet. To set up automatic deduction. New tenant drove to Starbucks. Set up a password. He could not finish. He was informed to come back to leasing office. She would help him. She demanded the new tenant to tell her his private & personal password. She said it out loud in the leasing office. So the other person in leasing office could hear it. The password would allow third party access to new tenants: Checking account and routing number. If they pulled money out early. It would cause new tenant to have a no rent paid. With late fees and penalty fees. Harassment. . .
