Trusts
Special needs trusts (also known as "supplemental needs" trusts) allow a disabled beneficiary to receive gifts, lawsuit settlements, or other funds and yet not lose his or her eligibility for certain government programs. Such trusts are drafted so that the funds will not be considered to belong to the beneficiary in determining eligibility for public benefits.
Power of Attorney
Advance directives are intended to answer the question of who decides for someone with diminished mental capacity. Many people believe that their spouses or their children will be able to make the necessary decisions, but unless a spouse or a child has been properly authorized under a Durable Power of Attorney or a Health Care Proxy.
