Cynthia Gitt received her B.A. degree from Wheaton College. In 1971, she received her J.D. degree with honors from George Washington University Law School, where she was elected to the Order of the Coif. Ms. Gitt was a trial attorney for the Equal Employment Opportunity Commission in Washington, D.C. from 1971 to 1974 and in San Francisco from 1974 to 1975. Thereafter, she was an assistant professor of law and director and litigator on behalf of the EEOC-funded Employment Discrimination Clinic at Wayne State University Law School from 1975 to 1977.

Employment Litigation
Many employers wish to litigate employment disputes in an arbitration setting. This usually is a quicker and less expensive way to resolve disputes and can involve retired judges or experienced employment lawyers as arbitrators. California has erected numerous obstacles to obtaining a valid arbitration agreement from employees and enforcing those agreements in court (or before the arbitrator, if the agreement is properly drafted). This is despite the fact that Federal policy favors arbitrations and prohibits treating arbitration agreements differently from other contracts, and that Federal policy preempts state laws. While waiting for the U.S. Supreme Court to resolve these issues again, employers wanting enforceable arbitration agreements are well-advised to consult with experienced counsel. Sexual Harassment
One area of employment law that remains the source of significant lawsuits (and plaintiff's awards) is sexual harassment claims under Title VII and the California Fair Employment and Housing Act (“FEHA”). The “Me Too” movement has given this claim even a bigger boost than it had previously, and the changing times have expanded this claim to cover far more than the original male on female harassment. Time is of the essence in addressing these claims; the California FEHA requires that they be immediately investigated.
