Traffic Violations
A person is classified as an Habitual Traffic Offender if they accumulate twelve traffic offenses within five years or four major offenses within five years (OWI, fleeing, reckless driving). Sometimes it is possible to reopen one or more of the past convictions and have those cases dismissed. However, the convictions need to be less than six months old and, preferably, be for operating after revocation. This is because prosecutors are willing to reopen and dismiss OAR cases if a person gets their license but they are normally not willing to reopen and totally dismiss a moving violation such as speeding.
Sex Crimes
On June 9, 1981 the Milwaukee Police were cruising the downtown Milwaukee area looking for a "rape suspect" when they came upon a troubled young man named Ernest Lacy. When the police tried to talk to Lacy he began to struggle with them. Lacy was eventually arrested and placed into the rear of a police van where he was later found dead. A Marquette University student, Mary Keane, saw the incident from across the street. She later testified that Lacy was already motionless while being pinned to the street by the officers. According to Keane, Lacy began to "spaz out" as the officers loaded him into the back of the police van.

. Immediately after filing the notice of intent, especially in misdemeanor cases, you should file a motion for release pending postconviction/appeal. The court may grant release pending appeal if the defendant is able to demonstrate that he has a reasonable chance of success on appeal, and that releasing the defendant will not endanger the community or create a risk of flight. Let's face it, though. If you are convicted of a serious felony, and the court has sentenced you to a substantial period in prison, you are very unlikely to be released pending appeal.

Laron Ball was on trial for murder in May, 2002 before the Honorable Jacqueline Schellinger. Ball had threatened mayhem if he were convicted and, when the jury returned a guilty verdict, Ball (who was not restrained in any way) lept into the jury box and was apparently heading for the window of the courtroom on the third floor of the Milwaukee County Safety Building. In the process Ball disarmed Milwaukee County Sheriff's Deputy Michael Witkowski. Ball shot Witkowski in the leg but, after a brief struggle, Ball was shot and killed by a Milwaukee police detective.

Making a Murderer, offers a balanced depiction of Steven Avery's trial for first degree intentional homicide is debatable. Nevertheless, there are many people-- including some celebrities-- who fervently believe that Avery is innocent, and that his trial was unfair. They are at least half right. Avery's trial was, in some respects, unfair.

Domestic violence is a huge problem in our society. There is no good excuse for violence toward family members, and this is why the law treats the problem harshly. For example, many police departments, including the Milwaukee Police Department, have a policy of arresting one of the parties any time the department receives a call for assistance due to domestic violence. The reason for the policy is obvious. The parties need to be separated. Additionally, a conviction for battery or disorderly conduct under circumstances of domestic violence may affect a person's right to possess a firearm. Not to mention the fact that domestic violence frequently leads to restraining orders and divorce.

Manslaughter - The unlawful killing of another without intent to kill; either voluntary (upon a sudden impulse); or involuntary (during the commission of an unlawful act not ordinarily expected to result in great bodily harm). In Wisconsin there is no crime of manslaughter. Rather, the levels of homicide are as follows: (1) First degree intentional homicide which is the intentional killing of another; (2) Second degree intentional homicide which is the intentional killing of another where the defendant had the privilege to act in self-defense but the use of deadly force was unreasonable; (3) First degree reckless homicide which is the killing of another by criminally reckless behavior evidencing an utter disregard for human life; and, (3) Second degree reckless homicide which is the killing of another by criminally reckless conduct where there state is unable to prove utter disregard for human life. There are also various forms of criminally negligent homicide.

O employer, labor organization, employment agency, licensing agency, or other person may engage in any act of employment discrimination as specified in s. 111.322 against any individual on the basis of... arrest record...." There is a similar law concerning housing. Therefore, if you suspect that you have been discriminated against on the basis of your CCAP entry, consult a good lawyer. A strongly-worded letter from an attorney threatening employment discrimination litigation is many times enough to totally solve the problem.
