Divorce
A comment made by your child, a neighbor’s child, a complaint by a student or false allegations made during a contested divorce can all result in a Child Protective Services investigation and possible termination of your parental rights.
Child Support
Child Support is the common term for payments from one parent to the other after divorce to contribute to the expenses of raising a child including food, clothing and shelter, extracurricular activities and school trips. The Friend of the Court agents manage these payments that have been determined by the courts based on the Michigan Child Support Formula Manual.
Child Custody and Visitation
When deciding Michigan child custody arrangements, courts look seriously at any parental request to move children more than 100 “road traveled” miles away from the other parent. Change of Domicile petitions can be some of the toughest legal battles during or after divorce. Courts use the reasoning that unless there are negative parenting factors, the children are best off with regular and consistent contact with both parents. It’s argued that driving more than 100 miles for visitation would cut off the other parent’s ability to participate in the children’s lives.
Adoption
Many couples, for a wide variety of reasons, turn to international adoption as they seek to grow their families. Prospective adoptive parents must comply with International laws as well as U.S. Immigration policies in order to bring an adoptive child to the United States. Premarital Agreement
There is a distinct difference between prenup and postnuptial agreements. The primary difference is the date at which they are signed. A prenuptial agreement is signed before the marriage. They are generally enforceable as long as they are fair, equitable, reasonable, and voluntarily entered into with a full understanding of the rights and assets of each party. Prenuptial agreements are generally uncommon because it is unusual for couples to enter into a marriage with an agreement already in place regarding the end of the relationship.
Guardianship
Wills Trusts are legal documents that provides instruction for the distribution of assets after death. The will can also give instructions for guardianship of children and even pets. The will allows you to make your preferences known for funeral arrangements as well as burial or cremation. A will is critical for cases involving heirlooms or high-value items like jewelry, cars or real estate that you may wish divided unevenly. Without a will, the courts decide who gets what based on a generic formula that favors close family. If there is a friend or distant relative that you would like to receive an inheritance, it must be detailed in a will. Even if you specify a preference verbally, without a will, the recipient may not have legal grounds for arguing your intent if the gift is contested by another family member.
Spousal Support
Spousal Support in Michigan, also known as alimony, is money paid to the spouse who will be in an inferior financial position after the divorce. Spousal Support is a discussion in every family law case. The legal trend is to award spousal support in Michigan in long-term marriages to the spouse who had to depend financially on the other spouse. Most commonly, spousal support is awarded to the spouse whose lack of job skills makes it difficult to get back on his/her feet after years in the home. Traditionally, that was the wife, however spousal support in Michigan can be awarded to either gender. There is no set rule, if, when, or how much spousal support can be awarded. Over the course of our practice, we have found that alimony has been awarded to one or the other party in about half of the divorces.
Legal Separation
Legal separation or a Separate Maintenance Action is a possible alternative to divorce. A separation is very similar to a divorce in Michigan but at the end of the process, you are still married. Annulment
Annulment is a possible alternative to divorce. Annulling your marriage essentially means that it never happened. If after marrying your spouse you subsequently learned that your spouse induced you to marry under fraudulent claims, you may have grounds to have your marriage annulled.
Child Abuse
Child Protective Services (CPS) is a government agency that acts to ensure the safety of children. When any reports of child abuse, child neglect, exploitation or abandonment arise, CPS is called upon to conduct an investigation. If CPS believes a child is in danger, they can remove the child or the accused individual from the home. The Michigan Department of Human Services manages the reports of suspected neglect or abuse. Unfortunately, it can be unscrupulously manipulated to cause harm to an ex-spouse during contentious divorce proceedings and heated child custody battles.
