Estate planning and wills- Estate planning involves planning for the transfer of property of a deceased person upon death by use of a valid will or a trust. Guardianship and elder law- Guardianship is the legal process for management of the property and personal needs of an incapacitated person. An incapacitated person is a person who cannot manage his/her own financial or personal affairs. Real estate transactions- For probate or guardianship, real estate frequently need to be transferred. Power or Attorney- A Power of Attorney may be useful to avoid a guardianship, which is subject to court supervision, and manage the affairs of an incapacitated person privately by a relative or friend chosen by an incapacitated person before he/she becomes incapacitated. Litigation- Some probate or guardianship matters require a trial or various hearings to decide disputed matters. Generally, the firm uses hourly rates for cases, but Donald E.
