Child Support
The automatic stay can also temporarily stop foreclosure proceedings, utility shut-offs, and evictions. However, the stay will likely not apply to certain proceedings, such as legal actions to collect child support or alimony, and certain IRS matters. In some cases, creditors may also ask the court to lift the stay.
Spousal Support
Possibly. Most consumer debt can be eliminated through a bankruptcy discharge. If you forget to include a debt in the paperwork, however, it will not be discharged. Moreover, creditors have the opportunity to object to the discharge of any debt. Some debts are considered “non-dischargeable,” which means you will have to pay them, and can include some tax debts, child or spousal support, criminal restitution, or fines/penalties owed to the government. Student loans are only dischargeable if you are unable to pay due to an undue hardship or you have a life circumstance such as a permanent disability that will make it impossible for you to repay that debt.

Keith graduated from Oregon State University with a Bachelor of Science Degree in Computer Science. He graduated from the University of Oregon School of Law in 1976 (Go Ducks!). Following his admission to the Oregon State Bar in 1976, he worked as an assistant district attorney in Eugene, Oregon. Keith then entered private practice in Eugene and later southern Oregon. During that time, his practice emphasized the representation of trustees, debtors, and creditors, including creditors’ committees, in business Chapter 7, 11, 12, and 13 cases. The diversity of legal issues presented in bankruptcy cases has led to the opportunity to expand his practice into other areas, including asset protection planning, business planning, business transactions, real estate, and foreclosure. He regularly represents banks, finance companies, and asset based lenders in all aspects of collection, including representation in the bankruptcy courts. His inside knowledge of the collection aspect of bankruptcy makes him particularly skilled at assisting his clients protect their assets.

Bankruptcy
There is no minimum amount of debt to qualify for bankruptcy. However, certain debt limits apply to Chapter 13 bankruptcy. The maximum amount changes periodically, but is $2,750,000 now. It is also important to keep in mind that there are limits on how many times you can discharge your debts in bankruptcy.
