Any time a child is born out of wedlock paternity issues may arise. Paternity may come up in the context of adoption, termination of parental rights, and child support and visitation issues. A standard paternity suit will often be initiated by the putative father (father asserting the biological connection to the child) in an effort to ensure parenting time or the biological mother in an effort to get financial and co-parenting support from the biological father. In many cases the State will initiate a paternity action against the biological father for financial support where the biological mother is receiving State aid on behalf of the minor child.

Most paternity suits are very much like many typical lawsuits in that you simply file a complaint against the biological mother or father. The suit may be filed in the county where the mother resides or the putative father resides.

Mr. Holdaway has extensive experience in the field of civil litigation and criminal defense. He received his Bachelors degree from Boise State University in Criminal Justice Administration and his Juris Doctor from the University of Idaho. While working on his J.D. Mr. Holdaway continued his training in the field of civil litigation and criminal defense through work completed with the Appellate Clinic. As a member of the Appellate Clinic Mr. Holdaway was able to work on, and argue, appeals before the Ninth Circuit Court.
DUI/DWI
Generally a driver who is arrested and/or charged with a DUI is subject to an automatic suspension of his or her driver's license. This suspension is considered a civil remedy and is separate from any criminal charges that may be filed against the driver. An ALS is subject to its own rules and proceedings separate from those a DUI defendant will encounter in the criminal court system. For over two years Mr. Holdaway has worked on and handled numerous cases involving “spice,” “potpourri,” “K2,” “bath salts,” and “bonsai plant food.”(AM-2201, AM-7220, ZZ1, B-122) These cases have ranged from simple misdemeanors to serious felonies. Mr. Holdaway has also acted as a lobbyist for spice groups in Idaho before the Idaho Board of Pharmacy as well as the Idaho Legislature and has testified concerning spice related issues before both the Idaho Board of Pharmacy and the Judiciary Committee of the Idaho Legislature.

As a practicing member of the Idaho bar Mr. Holdaway continues to handle appeals before the Ninth Circuit Court of Appeals and Idaho Supreme Court. He also has handled civil cases covering personal injury, contract disputes, property boundary disputes, securities fraud, social security, and 1983 actions, and has worked on criminal cases dealing with first degree murder, theft, and controlled substances.
