At the law office of Catherine Charuk, I am a solo practitioner representing clients in the areas of divorce and family law, wills and estates, and guardianships and elder law for Kingston, Ulster County, New York and surrounding areas. I also have what is known as a general civil practice, which means I accept cases in a variety of non-criminal areas outside these fields.I strive to help clients through the emotional and legal difficulties that often accompany legal issues by carefully assessing their concerns, goals, and options. I make certain to educate my clients about the law that governs their particular legal matters. I am honest with my clients about the challenges they may face. Estate planning is important in protecting your family assets if you anticipate in the need for long-term care in later years. When clients have this goal, I point out that Medicaid is actually public assistance for the poor, so in order to receive it to pay for long-term care a client must become poor. If steps are taken in a timely fashion precious family property can remain in the family, while the elderly person can still qualify for needed health care.
Wills
The public is increasingly aware of the importance of leaving clear and specific health care directives, also known as living wills. I can help clients convert their deeply held religious beliefs and personal preferences into legal documents that will protect them and their families from needless confusion and uncertainty should they become incapacitated.
Power of Attorney
I understand how to help establish a guardianship or handle a related matter with sensitivity and detail. I will explain how the guardianship works and how it differes from a power of attorney. For example, I will help you understand whether, and how, a guardianship will allow you to make health care decisions, manage financial affairs, make living arrangement decisions, or make “living will” types of decisions for an elderly or disabled family member in the State of New York.
