Divorce
Child Support
The Court of Appeal agered with Mr. Adelstein that the trial court had miscalculated child support by estimating the timeshare rather than actually calculating it. However, the Court of Appeal disagreed with Mr. Adelstein's claim that the trial court had miscalculated the percentage of the husband's bonus due under a marital settlement agreement and Smith-Ostler.
Child Custody and Visitation
The non-custodial father filed a request for a modification in the child custody order increasing his custody time. In response, the wife filed a declaration seeking to increase her time. The trial court sided with the mother. The father appealed. Mr. Adelstein represented the mother on appeal.
Spousal Support
October 2015. A partial victory. The Court of Appeal agreed with Mr. Adelstein on one of two appellate issues involving child and spousal support. The case is In re Marriage of White (B251847).

Criminal Defense
Criminal appeals are very difficult to win. The Court of Appeal affirms in about 96% of criminal cases. Mr. Adelstein has handled several appeals involving criminal law.
Wrongful Death
The plaintiffs sued for elder abuse, wrongful death, and other torts. The parties had previously entered into an agreement providing for arbitration. After the plaintiffs sued, the defendants had conducted discovery, filed numerous motions, waited a considerable amount of time, and then moved to compel arbitration. The trial court held that the defendants had waived their right to arbitration by actively litigating the case. The defendants appealed, and Mr. Adelstein represented the prevailing plaintiffs on appeal. The Court of Appeal agreed with Mr. Adelstein and the trial court and affirmed.
Robbery
The prosecution initially charged the defendant with first-degree murder, consisting of both felony murder and premeditated murder. The case was tried on both theories. Just before the jury was instructed, the prosecution decided for tactical reasons to drop the premeditated murder charge and proceed just on felony murder. The jury convicted him of felony murder but surprisingly acquitted him of robbery, the underlying felony. The defendant then appealed, and his conviction was reversed on other grounds and sent back for a new trial.
Murder
The defendant was convicted of first-degree murder. He and an accomplice were driving in his car and they decided to rob someone. They attempted to do so, and the passenger shot and killed the victim. The defendant was arrested and his friend disappeared. The evidence was conflicting as to whether the defendant was the driver or passenger in the car.

From 1992 to 1996, Mr. Adelstein was litigator at a large national law firm and an appellate lawyer at later a smaller appellate firm. Construction Litigation
This was a complex construction defect case. The owners of a large apartment complex that was damaged in the Northridge earthquake sued several design and construction companies for faulty repairs to the complex after the earthquake. The procedural history was complex. In a series of orders, the trial court sustained demurrers to various causes of action, struck certain allegations from the complain, and dismissed some defendants entirely. The result was essentially to gut the plaintiffs' case. Mr. Adelstein represent the owners on appeal and obtained almost a complete reversal, thereby reinstating virtually all of the claims against virtually all of the defendants. The case involved complex issues regarding fraud and misrepresentation; alter ego, conspiracy and agency allegations, and the dividing line between contract and tort claims as set forth in Aas v. Superior Court (2000) 24 Cal.4th 627
Property Damage
A toilet overflowed causing damage to the homeowners' home. Several months later, while it was being repaired, a small fire caused some additional damage. The insurance company failed to pay for some of the damage and other expenses, and the homeowners sued. The case raised issues involving repairs to the house, property damage, and ALE (additional living expenses) for two separate losses. The insurer removed the case to federal court and successfully moved for summary judgment. Mr. Adelstein represented the homeowners on appeal, and the Ninth Circuit reversed the summary judgment.

Bankruptcy
Mr. Adelstein represented a husband in an earlier appeal. The Court of Appeal increased the amount the wife owed the husband pursuant to the family court judgment. The wife did not pay the additional money to the husband. Instead, she spent some, hid some, and paid her lawyer some. Eventually, she paid some of the money to her former husband and then filed a Chapter 7 bankruptcy, seeking to discharge the debt.
Foreclosure
A bank loaned money to a general partnership to develop a shopping center. The loan was secured by a note and a trust deed on the property, both containing an attorney's fee provision. Ten years later, the partnership was unable to make the balloon payment. The parties agreed that the bank was entitled to a foreclosure judgment and stipulated tot his. However, they disputed the existence and amount of the deficiency. The trial court awarded the bank attorney's fees, even though the case had not been finally resolved and the bank might not have obtained any deficiency judgment.
