Prior to joining Heebner, Baggett, Upchurch & Garthe, P.L., Mr. Garthe was the C.E.O. of The Lone Palm Company, L.L.C., Executive Vice President and General Counsel for Medtx Corporation, and practiced with the law firm of Smith Hood Perkins in Daytona Beach, Florida. He is licensed to practice law in all courts in the States of Georgia and Florida. He is a member of the Volusia County and American Bar Associations and has been involved in numerous multi-million dollar commercial transactions.

Mr. Heebner is a principal/partner in Heebner, Baggett, Upchurch & Garthe, P.L. He received his undergraduate degree at Stetson University. Following his tour of duty as an Army infantry officer, he received his J.D. degree from Florida State University when he was a member of Law Review and Moot Court. Mr. Heebner initially served as an Assistant State Attorney before entering private practice. He has served as Counsel for the Ponce de Leon Port Authority, the City of Daytona Beach Shores, the Daytona Beach Downtown Development Authority, and the Board of Trustees of Daytona State College. He was appointed by the Governor to the Florida High Speed Rail Committee, the Federal Judicial Nominating Committee, and as the Chairman of the Florida 7th Judicial Circuit Nominating Committee. Mr. Heebner is a member of the Florida Bar Construction Law Committee and the Environmental and Land Use section of the Florida Bar.
Eminent Domain
Mr. Upchurch is a principal/partner in Heebner, Baggett, Upchurch & Garthe, P.L. He is a life-long Florida resident and Eagle Scout, obtaining his undergraduate degree from Furman University and his J.D. degree from Stetson University College of Law. Following graduation, he joined the firm of Cobb, Cole and Bell as an associate attorney, representing clients' interests before the Florida Legislature. Subsequently, Mr. Upchurch worked in excess of six years for the Office of the Attorney General, where he started in the Sales and Use Tax Section and was promoted to the Senior Attorney position within the Eminent Domain Section.
