Wrongful Death

Ballard, 314 S.C. 40, 443 S.E.2d 802 (1994), the South Carolina Supreme Court held that “[u]nder S.C. Code § 15-51-20, a personal representative may bring a wrongful death action for the benefit of statutory beneficiaries, including the parents of the deceased where there is no surviving spouse or child as in this case.”

The essential elements of a conspiracy to violate 21 U.S.C. § 846 are (1) an agreement between two or more persons to undertake conduct that would violate the laws of the United States relating to controlled substances and (2) the defendant’s willful joinder in that agreement. United States v. Clark, 928 F.2d 639 (4th Cir. 1991).

The crime of conspiracy is actually a separate criminal offense. Hanford v. United States, 231 F.2d 661 (4th Cir. 1956). United States v. Zabic, 745 F.2d 464, 474-75 (7th Cir. 1984).

Amnesty Plus is an Antitrust Division program that allows a company which is currently negotiating a guilty plea regarding antitrust violations to obtain more lenient treatment by offering to disclose the existence of a second, unrelated conspiracy. Under these circumstances, a company that chooses to self-report and cooperate in a second matter can obtain “Amnesty Plus,” wherein the company will receive amnesty for the second offense, pay zero dollars in fines for its participation in the second offense, and none of its officers, directors, and employees who cooperate will be prosecuted criminally in connection with that second offense. The company will also receive a substantial additional discount by the Antitrust Division in calculating an appropriate fine for its participation in the first conspiracy.
