My experience at Ferriter Scobbo has been in complex litigation and commercial disputes including pre-trial, motion practice, trial, appeals and post-judgment matters. I was part of the Ferriter Scobbo team that successfully defended a multi-year dispute regarding the alleged breach of a multimillion dollar power purchase agreement. Iâ€™ve defended claims alleging breach of contract, tortious interference with contract or business relations, infliction of emotional distress, and employment discrimination, harassment and retaliation.

This was an incredibly unique undertaking, never done in this state before. This was to become, at the time, the largest on-shore wind development in Massachusetts. Carefully, and working very closely with management and directors, Ferriter Scobbo laid out a course of action in a step-by-step plan for getting the turbines up and operating: it entailed everything from the creation of a special purpose corporation taking advantage of multiple statutory benefits and multiple financings including taxable and tax-exempt debt, land-use zoning and project siting, eminent domain land taking, easements, litigation and environmental permitting. The project spurred the creation of multiple contracts including: asset purchase agreement, turbine purchase, public relations, EPC/construction, site security, as well as contracts for the purchase and the sale of electric energy and capacity, transmission interconnection agreement, and more.Â We communicated to the client what we knew had to happen, our anticipated timeframe, and costs, for carrying each step out.

Issue: Our client, Danforth Green, LLC, had worked for months with a Massachusetts town to satisfy its concerns and obtain zoning variances for a new 353-unit apartment and condominium development. Â In late April 2013, less than a month after Danforth got its variances, a self-proclaimed local activist appealed the variances to the Massachusetts Land Court.Â Â Danforth asked us to take the case.Â But Danforth didn't simply want a win.Â The activistâ€™s appeal was preventing Danforth from getting a building permit.Â The Land Court had assigned the case to its â€œFast Track,â€ but the projected time for resolving cases on that track is sixteen months. Danforth didnâ€™t have sixteen months.Â It needed a win at record speed.Â
