Criminal Defense
When a citizen is placed on probation, he or she is required to comply with all of the terms and conditions that are imposed. Any violation will almost always result in an Affidavit of Violation of Probation being filed and the Judge issuing a Warrant (usually No Bond). VOP Hearings only require the State to prove the violations by a preponderance of the evidence rather than beyond a reasonable doubt, hearsay is allowed with limited exceptions, and the Defendant can be required to testify. If found in violation, the Judge can sentence the citizen to significantly more punishment than what was originally imposed including but not limited to substantial jail or prison time. DUI/DWI
DUI and BUI are crimes associated with operating either a motor vehicle or a boat while under the influence of alcohol. In Florida, you can get a DUI for driving or being in actual physical control of a vehicle while under the influence or with a blood alcohol concentration of.08% or greater. After you are arrested, you will be asked to submit to a Breathalyzer test. If you refuse, your driving privilege can be suspended for six months. In order to prove assault, the State must prove there is a threat to do violence, there is an apparent ability to do so, and that such violence is imminent. Aggravated Assault (Florida Statute 784.021) is more serious in that it is an Assault with a deadly weapon and it is a 3rd degree Felony punishable by up to 5 years in prison.

Let us start with a live in person hearing we had yesterday involving a Petition for a Restraining Order against my client who is a wonderful father and a great guy. The Wife filed for this restraining order based on claims of domestic violence and got a judge to sign off on a temporary restraining order ex parte (without my client even having notice). As a result, my client was actually removed from his home. The case was set for final hearing and I was then retained.
