Just Say No!

I agreed to use Ms. Tolt in a Mediation, and the matter settled. After the Mediation, Ms. Tolt drafted a Declaration for one party against another. In the Declaration, she recited several Attorney/Client conversations and recited Mediation discussions. No Waiver of the Attorney/Client Privilege was made by the Client, and Mediation discussions are not disclosable under any civil circumstances. Cassel v. Superior Court 51 Cal. 4th 113. The Declaration was ultimately provided to Opposing Counsel, which is about the worst possible thing that a Neutral can do in litigation. I believe her actions were irresponsible and unethical, and I will never agree to have Ms. Tolt in a Mediation again.
