If a testator gets divorced or receives an annulment, the will remains effective to the extent that, (1) where the spouse is the executor under the will, such appointment would be void, and (2) any gifts to the spouse under the will would be void, unless the testator states otherwise in the will.

The sources of international hot money include drugs, financial or white collar crime, smuggling of highly taxed items, such as alcohol or tobacco, and organized crime. White collar crime includes a variety of offences, such as bank fraud, credit card fraud, investment fraud, bankruptcy fraud, and embezzlement. Organized crime comes from traditional locations such as Italy, Colombia, Japan, and the Far East, but also from Russia, Eastern Europe, and Nigeria. When possible, they use instantaneous electronic funds transfers to confuse the audit trail.

The trend is away from drug trafficking alone to fraud and other white collar crimes which attract lower criminal penalties, and away from banking to non-bank financial institutions, such as exchange offices and remittance services, and non-financial professions, such as accountants, lawyers, secretarial companies, notaries, financial advisors and other fiduciaries. Cash smuggling continues to be significant, especially where there are inadequate or no border controls.

Mutual Legal Assistance needs to be flexible and adapt to change. I have just completed a study of 72 such court cases in the Bahamas since 1990. That is a credible record. The applicants are all ex-parte requests for banking information in which only the Bahamas Attorney General was present, not the accused. I stressed in an article written 10 years ago that accounts could be frozen and restraining orders could be obtained over money and assets in at least half a dozen ways until the opposite side is heard. Now, there is no room at all for the other side to be heard before his privacy is violated and his records are released.

I am going to tell you a little story about money laundering. There is something called "harmful tax competition." You have beard about the OECD report and the Edwards reports, and other reports about harmful tax competition. But frankly, to my mind, that is an oxymoron, because it is legitimate to reduce your tax expenditures. They are exactions, not voluntary contributions. At the same time, one should stay within the law. Some years ago, this was the theme of a conference in London and it was believed that all offshore centers should be closed down. At the same time, the Inter-American Development Bank (IDB) and the Caribbean Development Bank and other financial institutions in the region, stated that the comparative advantage of the area in the 21st century is in services. Services including banking, finance, IT and tourism. The Caribbean countries have almost without exception -- I am referring specifically to the English-speaking Caribbean countries -- dealt with rule of law questions and corruption questions quite effectively and they continue to allocate resources to this area. Continuing attacks on sovereignty occur, is not helpful, does not work, and in any case, David won. The private business sector on both sides of the Rio Grande and also both sides of the Florida Straits, want anxiously to move on, particularly in those areas where there has been a concerted allocation of resources in this effort without much of a return.

The Bahamas, as a premier centre for tourism and business, promotes an investor-friendly atmosphere. Investment in homes, hotels, resort complexes and other businesses is encouraged. Real estate sales and building construction play an important role in the overall development of the Bahamian economy, which consists primarily of tourism and financial services. Therefore, the Government’s investment policy aims for substantial and consistent growth in the real estate field. For the first time, a separate ministry of government has been established, called the Ministry of Financial Services and Investments. In the National Strategy on Financial Services of October 2002, the Minister announced the Government’s intention to streamline the procedures and to expedite the approval of the applications associated with property purchases. The Government promised to replace the red tape with the red carpet, and also to increase the linkages between tourism, investment, real estate and property development.
Property Damage
This bill forbids a person from using or permitting the use of a motor vehicle on a public road unless there is a valid policy of insurance for third party risks or such security which complies with the bill. In my opinion the words ‘or such security’ should be deleted because they are a reference to the outmoded practice of leaving a deposit instead of taking out a policy. Claims are now so large for death, bodily injury or property damage that a security would not be satisfactory or practical.

The problem is largely one of rates. Unlimited liability as in Barbados poses a serious reinsurance problem. Reinsurers are said to be quite unwilling to touch unlimited liability for personal injury. Therefore, a maximum limit should be set. The Trinidad limit seems reasonable, but reference should be made to the case law. The criterion should be the highest relevant court award in the region, with periodic adjustments as new cases are decided.

Any delegate so appointed shall be considered an agent of the trustee for the purposes of subsections (6) and (7) of Section 30.

The Act is not intended to be a stumbling block for legitimate credit transactions. It provides that banks, trust and insurance companies licensed in the Bahamas which acquire an interest in or take possession of property under the terms of a mortgage or debenture are exempt from obtaining a prior permit. However, any non-Bahamian or non-Bahamian entity going into possession as a mortgagee or acquiring land under a court order must register that acquisition or fact of possession. Acquisition by way of foreclosure under a mortgage or of land acquired by an authorised foreign state will not require a permit, but must be registered.
