Traffic Violations
Significantly, there has been an increasing number of automobile accidents involving a driver who was texting and driving. In fact, as of October 1, 2013, it is now illegal to text and drive in Florida. The "Florida Ban on Texting While Driving Law" (SB 52) now makes texting while driving, and emailing while driving, finable traffic infractions. A first violation is considered a non-moving infraction. However, a second or subsequent violation within five years will be considered a moving violation for the purpose of fines and the assessment of points. Notably, the law does not ban the use of a cell phone for browsing the internet or the usage of applications while driving. There is also an exception for use of the GPS navigation feature on a phone. Also of note, the law is considered a secondary offense. This means that a person cannot be pulled over simply for texting and driving. Rather, a person would have to first be pulled over for a primary offense (for example, not wearing a seatbelt, driving with a headlight out, speeding, etc.) before they can be issued a ticket for texting while driving.
Hit and Run
Unfortunately, many of these accidents are hit-and-run incidents in which the motorist leaves the scene and cannot be identified. In these cases, injured pedestrians often are able to obtain personal injury recoveries through their own personal injury protection (PIP) insurance policy.

Workers Compensation
Many people do not realize that when they are injured in an accident while driving for work, there are potentially multiple claims that can, and must, be brought, including a Florida Workers' Compensation claim.

Premises Liability
Premises liability includes two types of situations. First, there are dangerous physical conditions which cause accidents. This includes spills on floors, improperly designed stairs or ramps that may cause trip and falls or slip and falls.
Property Damage
If the at-fault person has property damage coverage, you can usually get their insurance company to pay for a rental while your car is being repaired. However, the insurance company will not do this until liability (fault) has been determined against their driver, and, usually, they will have a requirement that they need to talk to their driver before they can make the determination. This sometimes can take a few days or more. In the situation where your car is not drivable, this can be a huge inconvenience. In that situation, if you have rental coverage under your own policy, it is probably best to use that, and possibly get the repairs done under your own insurance (then your insurance company will get repaid from the other insurance company, once fault has been established) – Note: you will be responsible for your deductible, if you use your own insurance.

Personal Injury
If you are involved in a car accident, your claims for medical bills and lost wages must be submitted to your own insurance company first, regardless of who is at fault. Under a state-mandated $10,000 personal injury protection (PIP) policy, your insurance pays the first $10,000 in medical bills and lost wages (excluding your deductible).
Medical Malpractice
I will immediately investigate all liability aspects of the case, along with all viable avenues for recovery, including any and all applicable insurance policies and/or “deep pockets.” Wrongful death claims are governed by Florida Statute 768, which dictate who can recover, how the claim must be brought, and how quickly a claim has to be filed, which is typically two years in Florida. Importantly, medical malpractice claims have additional restrictions and rules that must be observed.
