Wrongful Death
Doe v. Sysco of Central Florida: On January 10, 2017, Cohen Milstein successfully settled a wrongful death lawsuit for $2.5 million against Sysco Corporation and one of its tractor-trailer drivers on behalf of the Estate of John Doe. John Doe, a 42-year-old Kissimmee, Florida man and father of two, died on October 20, 2015 after his semi-truck struck a Sysco owned and operated tractor-trailer that had run a stop sign. Cohen Milstein worked closely with police investigators and experts to prove that Mr. Doe was not at fault; rather the Sysco driver violated his right of way and caused the crash. Evidence proved the Sysco tractor-trailer failed to slow down and ran through a stop sign into oncoming traffic despite clear stop bars and a visible stop sign.

On October 16, 2018, Cohen Milstein and co-counsel filed an unsealed version of their fourth amended complaint in a putative consumer class action regarding two inflated video metrics that Facebook disseminated to advertisers. Plaintiffsâ€™ third amended complaint alleged that Facebook violated Californiaâ€™s Unfair Competition Law (Â§ 17200) and breached their implied duty to perform with reasonable care. The fourth amended complaint adds an allegation that Facebook committed fraud, based upon internal documents produced by Facebook in the litigation. Specifically, the fourth amended complaint allegesÂ that, even once Facebook decided to correct the false metrics, it chose not to do so immediately. Instead, Facebook chose to continue disseminating false metrics for several more months while it developed and deployed a â€œno PRâ€ strategy designed to â€œobfuscate the fact that we screwed up the math.â€

Workers Compensation Abuse: When the patient is an injured worker whose medical care or treatment is wrongfully denied or delayed by her employer or the workersâ€™ compensation carrier, the law often requires that the employer or carrier must have caused the denial or delay through an intentional course of conduct in order to be subject to civil liability. Â Satisfaction of this standard can be difficult and deters many law firms from bringing civil actions for the wrongful denial of treatment to an injured worker. Employment Discrimination
Breen v. Chao (D.D.C.): On April 28, 2021, the Department of Transportation and Federal Aviation Administration agreed to a record-breaking $43.8 million settlement to end a 16-year-old lawsuit alleging discrimination against 670 former Flight Service Specialists who live in nearly all 50 states. The settlement, the largest ever reached in an age discrimination lawsuit involving the federal government, concludes this ligation. Cohen Milstein and co-counsel represented of Flight Service Specialists in this age discrimination lawsuit.
Employment Contract
In addition, the Defendant agreed to a code of conduct that provides protections for current and future seamen aboard his vessel, including guaranteed access to passports, medical attention for injuries, minimum rest hours and appropriate protective clothing at no cost, the right to terminate the contract early without incurring penalties, and employment contracts in the employeeâ€™s own language. At the final approval hearing, Judge Walsh described the settlement as, â€œgroundbreaking,â€ â€œextremely valuable,â€ â€œcomprehensive,â€ and codifying a â€œbest in class approach... to address sexual harassment, sexual misconduct, discrimination, retaliation, inequity and inclusion in the workplace.â€ He commended the â€œexcellent counselâ€ and stated that â€œ[a]chieving such a settlementâ€ is â€œa credit to what... your profession can do to solve a problem.â€

Property Damage
The remainder of the $600 million settlement fund will be divided among class members and individual claimants, with the bulk of the funds, 80%, set aside for children and heavily weighted toward children who were exposed to lead at age 6 or younger. Another 15% of the funds will be distributed among adult claimants, 3% for property damage claims and 0.5% for businesses, with the remaining 2% designated for local school districts to provide special education services to affected students.
