Child Support
Parent not entitled to altered visitation during summer months even if they are off work and the child is at the other parent’s home unsupervised. Parents were disputing visitation and child support. The father asked for altered visitation during the summer months because he was off work and available to spend time with the child. The court heard testimony and determined that the child was old enough to stay home alone during the mother’s working hours. The court determined that because the child was old enough to stay home during the mother’s working hours, the father was not entitled to visitation just because he was not working during the day.

Premarital Agreement
Court finds premarital agreement did not exclude division of assets acquired during marriage. The parties entered into a premarital agreement. Some of the husband’s property was inadvertently omitted from the agreement. The district court gave the wife part of a savings plan listed as part of the husband’s premarital property in the agreement, as well as part of an annuity that was omitted. The husband appealed, arguing that she was not entitled to any of the plan or annuity. The Supreme Court held that the savings plan and annuity had earned money during the marriage. The wife was entitled to part of the money because the premarital agreement did not allow the husband to keep the benefits earned from the plans during the course of the marriage. Sitz v. Sitz, 275 Neb. 832 (2008).

Spousal Support
The Iowa Supreme Court finds that medical support payments were spousal support and subject to modification: The parties were divorced in 2004. As part of the dissolution, Husband agreed to pay to Wife $300.00 per month for health insurance costs. Wife remarried and Husband sought a modification to terminate his obligation to pay the $300.00 per month. The district court determined that the monthly health insurance payments were part of the property settlement and determined that, as such, were not modifiable. This was affirmed by the Iowa Court of Appeals. Upon further review the Supreme Court stated that as a matter of law a provision in a dissolution decree requiring one spouse to provide medical support in the form of health insurance payments to the other spouse is modifiable spousal support under Iowa Code §598.21(3).

DUI/DWI
The circuit court used a criminal jury instruction on DUI regarding the presumptions of blood alcohol levels. On appeal the court held that the criminal instruction was not appropriate in the civil case because it only considered BAC and that the jury should consider other evidence of impairment. Furthermore the court on appeal believed that the Plaintiff violated the order in limine suggesting that because he was not prosecuted for DUI he was not driving under the influence. The court opined that this improper suggestion probably prejudiced the jury so the case was reversed and remanded for a new trial.

Wrongful Termination
Employee who made "internal whistleblowing" complaint about forged training records can file a claim for wrongful discharge in violation of public policy. The state mandates training for facilities that care for patients with dementia. An employee made an internal complaint related to forged training documents. The employee was later terminated and brought this claim. Public policy is generally found in statutes and the state constitution but it can also be found in regulations meant to protect patients with dementia. The employee was protected by the internal complaint because otherwise employees would be reluctant to report activity if it put their jobs at risk. This was the first case that allowed an "internal whistleblowing" complaint and therefore punitive damages were not available.

Sexual Harassment
Qualified Immunity does not exist when a supervisor is engaged in a consensual relationship that becomes unwelcomed and a sexual harassment claim arises from the conduct. The employee entered into a voluntary sexual relationship with her supervisor. The employee wanted to discontinue the relationship, however, in doing so she was afraid that she would lose her job. She alleged that at least three other employees had been fired after discontinuing sexual encounters with the supervisor. She informed her supervisor that she was uncomfortable continuing the relationship and was fearful that she would lose her job. The supervisor made sad faces at her while she worked and made efforts to be in the area where she clocked out after work. She eventually went to another shift to avoid any contact with the supervisor. The Court held that allegations were enough to survive summary judgment and the supervisor's conduct violated a clearly established right to be free from a hostile work environment.

Premises Liability
Grocery store employee who was not yet on duty, was riding a bicycle, and struck a customer did not give rise to a claim against the store under a theory of respondeat superior. A grocery store employee arrived for work approximately 30 minutes early but realized that he had forgotten some of his required attire. He requested and was given permission to return home to retrieve the attire and return to work. While he was leaving he struck the plaintiff at a fairly high rate of speed causing the olive oil bottle she was carrying to shatter and cut her forearm and wrist. Her ankle was also broken. She required stitches, twelve pins, and two plates to treat her injuries. The lower court dismissed the respondeat superior claim because the employee was not on duty and not acting within the scope of his employment. However, the court remanded the case for further proceedings regarding the store's premises liability for failing to eliminate or warn against the risk from the "blind" exit of the store where the accident happened.
