Criminal Defense
People undermine and sabotage good EEOC charges all the time by not bringing a lawyer in to help them frame their case, or help them interface with EEOC. It is not “required” to have a lawyer assist at the EEOC level — but it also is not “required” to have a criminal defense lawyer, because you can represent yourself in court — you make the call.

If a person at work touches you offensively, such as sexual grabbing, etc., then he has committed an “assault and battery” on you regardless of the number of employees who work there.
Restraining Order
If a TRO is issued, there will probably be a hearing within 15 days in front of the judge, regarding whether to continue the restraining order. At that hearing, you can put on witnesses and present evidence. If the judge thinks the former employer has the better case, then you will be prevented from further violating the agreement during the lawsuit process (but the lawsuit process continues – the hearing is not a trial).

Unfair Competition
The judge will try to balance competing interests. He will consider the employer’s main interest: protecting itself from unfair competition from someone (you) who knows his secrets and his customers. He will consider the “public’s” interest in the free enterprise system, and in keeping people off of welfare. He will consider your personal situation and the hardships that will befall you if he enforces the restrictions. He will also consider how fairly or unfairly the parties behaved toward each other during and after the employment.

Workers Compensation
Don’t bother thinking that “exclusive causal connection” is the same as saying “direct result.” It’s not. In 1999, the Missouri Supreme Court ruled on that issue in the Crabtree case. In the Crabtree case, the employee won the case after successfully proving to a jury that the retaliation was the “direct result” of exercising a workers compensation right. On appeal, the Missouri Supreme Court reversed the jury verdict. The Court said the employee must prove an exclusive causal connection.

Employment Discrimination
On June 14, 2004 the United States Supreme Court issued a landmark decision setting some new standards for the law of “Constructive Discharge” in Federal Title VII Employment Discrimination cases. The Supreme Court Case is available on the web: Pennsylvania State Police v. Nancy Drew Suders (USSC 6/14/04). —- I don’t know whether you can grasp the importance of this case, as a layman, but the case will percolate throughout the courts over time.
Employment Contract
DON’T TRY TO DO IT YOURSELF! — Medical or health care professionals, particularly physicians, tend more and more to work under written employment agreements that are personalized for them. I still see contracts where the medical facility presents the same contract to each professional, with only the salary changed, but that’s becoming less common in my experience, particularly for physicians. I think the main motivator for this change has been the aggressive enforcement of the Medicare anti-kickback regulations, with their “safe harbor” provisions.
Employment Litigation
Merely electing Democrats will not fix the employment laws, because Democrats got us into this mess. We must elect candidates who are progressive on the employment issues that mean something to people.
Non-compete Agreement
Non-competition agreements (also known as “non-competes”) are enforceable in Missouri against physicians, but the court will apply basically the same criteria as it would to non-competes in the non-medical sector in determining whether your particular non-compete will be enforced against you. Read my article on non-competes for more information of a general nature about how Missouri courts view non-compete agreements.
Severance Agreement
This article does not focus on what to do if the employer failed to give you the right amount of “severance pay” under the company’s standard severance pay program. If the company has a standard, published, severance pay program, and the employer does not honor its obligations, then you may have an Erisa benefit problem.

Disability Discrimination
NOTE: For some types of discrimination, the Federal laws do not apply to state government employees, and so the MCHR is your only avenue of complaint. The Federal age and disability discrimination laws have been ruled to not apply to State Government Employees (other Federal discrimination laws could be next on the chopping block). File with the MCHR within 180 days to protect your rights. At your peril, you could choose to file with the Equal Employment Opportunity Commission (EEOC), but you still must file within 180 days to protect your rights under Missouri law. You have 300 days, in total, to file with the EEOC to protect your rights under the Federal discrimination laws that still apply to State workers.
