Divorce
We have experience drafting all manner of formal agreements regarding divorce and family law in Oregon. It is important to have an experienced attorney guide you through the process of drafting, reviewing, and explaining the prospective agreement.
Child Support
The Oregon legislature requires that divorced and unmarried parents to financially support their children. A parent’s obligation to pay child support generally ends when a child turns 18 years old, or reaches age 21 if the child is attending school or vocational training.
Child Custody and Visitation
Every judgment involving child custody must include a “parenting plan.” Parenting plans may be general or detailed. The best result for a child is for the parents to work together on what parenting time is in the child’s best interest. To avoid disputes, however, it is a good idea to have a “default” parenting plan, which sets forth the contact each parent has with the child, in the event there is a disagreement. Your parenting plan should address each the weekly contact with your child, holidays, and vacations. In addition, a parenting plan may address who provides transportation, what happens when a child is ill, telephone contact, and other concerns you may have. Most counties in Oregon have a sample parenting plan. Yamhill County’s sample parenting plan is attached.
Paternity
Child support issues can come up in divorce cases, custody cases, paternity cases, and modifications of preexisting support orders. The Oregon Division of Child Support has created a calculator for child support. The number produced by the formula is presumed to be correct, however there are many “rebuttal” factors that may affect the final support amount. ( click here for calculator )
Premarital Agreement
People contemplating marriage may have concerns about the potential for divorce, and what a court might do regarding spousal support, and the division of assets and liabilities. During a divorce, couples often disagree concerning how a division of property should be made. One way to avoid the potential high legal costs and emotional toll is to enter into a premarital agreement before marriage. Unmarried couples may also choose to address these issues through a Cohabitation Agreement.

Spousal Support
Spousal support is a very individualized part of a divorce. In some cases, one spouse may have to pay the other spousal support. Oregon law provides three kinds of spousal support: transitional spousal support, maintenance spousal support, and compensatory spousal support.
Legal Separation
When your divorce, legal separation or paternity case is filed with the court, you may ask the court for an award of a “temporary order.” Temporary Orders, or what courts refer to as a “pendente lite” orders, are used to temporarily resolve issues, such as, custody, parenting time, child support, spousal support, exclusive use of the home, etc., while your case is pending. You can ask the court to order support for you and/or the children, award you exclusive use of your vehicle and home, or provide various other forms of relief all while the case is pending. The other party has an opportunity to object to your requests. A hearing will be held if an agreement is not reached about how to handle issues while your case is pending. The court will then hear your evidence and make its decision on the temporary matters. Temporary orders are not a final decision, but can have a significant impact on setting the tone of your case and affecting the final outcome.
