Jock Sturges, award-winning fine arts photographer, whose work depicts nude women and children, has been at the center of controversy over his books. Anti-porn activists, led by Randall Terry, former leader of Operation Rescue, have been demanding that Barnes & Noble and Borders bookstores remove copies of Sturges's Radiant Images. Books by Sturges and others have also been destroyed by protestors in orchestrated incidents from coast to coast. These protests, which began in August 1997, have been condemned by PMA, and its fellow Media Coalition members. To date, two Barnes & Noble stores in Alabama have been indicted on child pornography charges. In one case, the indictment was dismissed. Barnes & Noble has refused to remove the book until there has been a legal ruling that it violates federal obscenity or child pornography statutes. Sturges's work, which is included in the Museum of Modern Art's permanent collection, has been reviewed by several district attorneys from around the United States, and deemed protected by the First Amendment.

Restraining Order
In late November, a federal district judge in Philadelphia issued a temporary restraining order delaying implementation of the CDA 2. As this article was going to press, PMA and other members of the Media Coalition were preparing a friend-of-the-court brief to be filed in ACLU v. Reno (Reno 2), opposing the new CDA 2 legislation. The brief emphasizes the nature of the Internet as a medium of communication and the importance of providing it with the highest degree of First Amendment protection. The brief points out the insufficiency of the credit card requirements, and the burden it will place on free speech, creating adult only zones on the Internet. The brief also stresses the advancements that have been made in parental control technology, arguing that more effective and far less speech-restrictive means exist to prevent minors from accessing harmful material on the Internet. Copies of that brief will be made available at www.cdt.org.

Workers Compensation
Keep in mind that characterizing a work as a "work for hire," could impose upon an "employer" certain obligations relating to state worker's compensation coverage, unemployment compensation, and other benefits for workers. So consult with your tax advisor before commissioning a work or hire -- both copyright and employee benefit issues may be involved.
Employment Contract
Unlike specially commissioned works, for works where a traditional employee-employer relationship exists, no work for hire agreement is needed. However to avoid any ambiguity, it's a good idea to include a well-drafted statement in the employment agreement acknowledging that any work created in the scope of employment will be considered a work for hire. The employment agreement can also include non-competition and non-disclosure provisions to protect your business's trade secrets.
Non-compete Agreement
Taking the boilerplate provisions for granted can also have serious consequences for authors. For example, a publisher’s standard agreement may contain an onerous non-competition clause that prevents the author from using material from the book in her day-to-day business. While no publisher will strike its non-compete clause completely, if asked properly, most will offer the author a more palatable version. Similarly, if the book is tied to an existing brand or business, the boilerplate should be revised to address the author’s trademark concerns. Book contracts typically give the publisher (not the author) the right to determine the title of the work. If the book is an extension or outgrowth of the author’s existing business (e.g., Working Solo®, Taming the Paper Tiger® ), approval and ownership of the title – which also functions as a service mark – becomes a critical issue.

Property Damage
It is important to speak with an insurance broker familiar with this type of coverage to find out exactly which types of claims are covered and which are not. For example, some policies cover claims of intentional infliction of emotional distress or misappropriation of ideas, while others do not. Other insurance policies offer optional coverage, for an additional fee, for claims for bodily injury or property damage resulting from negligent advice or instructions.
