Gave credit card info for an application fee but fraudulently charged over a month later for a security deposit that I never authorized!!!

I was going through a lot at home so in order to weigh my options of possible locations to move to I applied to 2 different apartment complexes to see if I would get approved for either. I paid the application fee which should have covered everything needed to check to see if I would get approved. I explained to the salesperson that I was only weighing my options. She said she understood my situation and that if I decided to accept the apartment to let her know. I went by and looked at the apartment after being approved. I told the salesperson I was still undecided about whether I wanted to move in or not and that I would call her if I wanted to reserve an apartment. I never called which should have indicated that I did not want the apartment. I never signed any paperwork. I never asked anyone to hold an apartment for me. I never setup a move in date. But low and behold, one month later I get a call asking if I was still moving in on Saturday. I told the lady nicely I never reserved and apartment. She said well you know your security deposit will be non-refundable. I replied to her that I never paid a security deposit. I hung up the phone. Looked at my credit card statement and there it was 2 days earlier, a security deposit charger from Saddleback Ridge. WHOAA!!! WHAT!!! Surely there had to be an error. So I called back and explained to the first person who answered the phone, then to the second person I was transferred to, then to the manager. I told her I never authorized that charge and that the card number was only given to them to process my application. Guess what the manager had to say. "Well you came by and looked at the apartment so we held it for you in 'good faith'." But wait, I never asked you to hold an apartment. The lady I spoke to prior to speaking with the manager said she had "assumed" I wanted the apartment since I did not call. So did that give her authorization to charge my card I used for the application fee??? No one called to ask if I wanted to put down a deposit to hold the apartment or anything. But guess what the manager said. When I came in and looked at the apartment, I entered into a "verbal legally binding contract". Therefore she would not give me a refund. Lol. Who ever heard of such a thing when it is in reference to signing a lease for an apartment. But the worst part was the last thing she said before we hung up. She said, "contact your lawyer". So I did just that. The first thing my lawyer asked was did I sign anything. Clearly the answer was no. The electronic signature was to authorize payment for the application fee. Then my lawyer asked so when are they gonna give you back your money. Same thing I was wondering. He advised me to contact the credit card company and file a dispute. So they were clearly in the wrong. You can't just take someone's credit card info and make whatever charges you want when the person gave you that info specifically to process an application. I checked the Saddleback Ridge website and right in the rental policy in fine print it said that if you do not pay a security deposit at the time you process your application an apartment will "not" be reserved for you. So what I have to ask to you Ms. Manager lady is, "How can you charge me for a security deposit on an apartment that I never reserved?" Electronically signed Mrs. Waitingonmyrefund
