Total misrepresentation of the law!

Total misrepresentation of the law! Person acquitted bc he was a ""peaceful"" Muslim. ONLY westernized Muslims are peaceful. Justice Mark W Martin should resign and charged with gross negligence.

The United States of America is founded on Constitutional Rights, one of which is the Freedom of Speech. Judge Martin violates the victims First Amendment Right to Free Speech. He calls the victim a ""doofas"". The judge also insults Christians by implying that Christianity is not a way of life, while Islam is. I have watched the video of Talaaq assaulting the victim. I have listened to the testimony of both sides. A police officer testified that Talaaq did in fact assault and batter the victim. This Judge in ruling for the defendant has in fact shouted to the world that if you proclaim to be Muslim, you are free to assault anyone in the US and claim it is because of your religious beliefs. In case the Judge has forgotten, there is also a Constitutional Amendment that allows for freedom of religion (the reason why most of the early settlers came to America to begin with). One would wonder if a similar ruling would have been made if the victim was Muslim and the attacker a Christian?
There needs to be a Judicial inquiry in this case and ALL of the Judge's cases should be reviewed.

This Judge is Ridicilous

I listened to parts of this actual court case between the atheist and Talaaq and this whole episode is distorted and messed up. Its ridiculous that the judge would say, In the middle of his lecture about Islam that,""He was well outside the bounds of his 1st amendment rights"" dressing up like a zombie Mohammad.? Thats scary islama theocratic talk. Then to call him a doofus was just wrong. This Judge needs to screw his head back on.

Is it okay to lie when taking an oath

I have listened to the recording of Judge Martin, and it has to be clear the biggest denier that the judge has violated his oath of office. I too have taken the oath to protect and defend the Constitution of the United States against all enemies, foreign and domestic. You judge Martin are an evil man who follows and evil ideology founded by an evil man. islam is an an enemy of humanity as much as nazism and members of the kkk. Pennsylvania you must remove this man from the bench. What he has done is advance the destruction of the Constitution and freedom he took a solemn oath to defend.

So judge, when some one vandalizes a restaurant that offends muslims by serving pork, or when someone engages in islamic honor killing will you defend that as well.

Does this give me the right to assault a Muslim dress as Satin in a parade? As a christian he would be insulting my beliefs and way of live showing the Devil would be an insult to me as being a blow against Christ.
I would not like to be in your cout on an animal abuse case as for all I know you may not like animals and would rule that there was no abuse.

Try looking that one up ""judge"" Martin. Free speech is protected, now matter how deplorable. As a matter of fact, the more deplorable it might be perceived, the more we protect it in this, the greatest Country on God's green earth. By your ruling ""judge"", one day, someone may think your right to express yourself from the bench is ""offensive"", and exercise their decsion to ""negate your offensive situation"". If and when that time comes, will you seek justice in the U.S. Constitution or the Koran?

Mark Martin has let his mythology interfere with holding up the laws of this country. He should have some decency and step down after this. Being known for having Rick Santorum as a Congressman and Senator is bad enough!

Judge Martin exercised very bad judgement

Why was he allowed to hear this case, in light that he himself is Muslim? Obviously this is a clear conflict of interest. There is separation of Church and State for a very good reason. Because he did not have the sense to recuse himself, he should be removed form the bench immediately.

I hope you someday need the protection of Sgt. Curtis, whom you effectively called a liar in your courtroom. Your Muslim faith has no bearing on this, except as you made it so. I'm sure judges of every faith (or none) have dealt with people who share their religion and people who hold antithetical beliefs. What you have done here is to discount the testimony of two witnesses (one of them a police officer) in favor of the testimony of one man, who should have been charged with perjury on top of the existing harassment charge. We can see the video judge. You are a disgrace to the bench!

Abuse of power, Oppression of a citizen using color of gov.

This guy pretty much broke the Rule of Law by his own admission and did not excuse himself from the hearing due to the fact that he is a self-proclaimed muslim which is a conflict of interest.

He needs to be impeached for breaking the Rule of Law (the highest law in the land).

In the process negating the rights afforded to a U.S. Citizen by the Constitution of the United States.

There should be laws that protect the Citizens of this land against corrupt individuals that break the justice system as they see fit, whilst victimizing our people in the process.

Judge Martin Should No longer be allowed to be a judge

The judge clearly cannot be objective and therefore should be thrown off the bench. It does not matter to me what you can be put to death for in Muslim Countries! What matters to me are the laws of the USA governed by the Constitution. Judge Martin should go back to any one of the Muslim countries he spent time in and stay there permanently. Maybe burn a few American flags to pass the time! What a BOZO. Glad I don't follow his god.

Judge Martin let our country down!

Judge Mark Martin needs to step down. He has proven himself incapable of being objective. He let his religion override the laws of our country. He ignored Title 18, Section 27 Code 9A1. No room for opinion, this is fact! I do NOT agree with Ernest Perce and/or the atheists of Mechanicsburg. I am a Christian. What I do agree with is upholding the laws of our country, not bending them because Talaag's actions were based on what is done in HIS country. Judge Martin needs to remember the separation of church and state!!

I never thought this could happen in the USA

One man attacked another man because he didn't like the clothes he was wearing. That is wrong and the attacker should be punished. To not punish the guilty is to disgrace the memory of the victim.

To say that the ""religion"" of Islam is more important than the United States Constitution is putrid. Outlawing the use of religious laws as an excuse for hatred and violence was fundamental to the foundation of America.

Judge Mark Martin allowed Muslim law to influence his decision to betray his oath to uphold the Constitution of the United States.

He should be permanently disbarred and tried for accessory to assault. As a start.

Disgrace to the Judicial System

District Justice Mark W Martin has committed the following wrongdoings in the case of Ernest Perce vs. Talaag Elbayomy:
1. Justice Martin told Mr. Perce that the First Amendment does NOT allow him to mock a religious/historical figure, in this case a brutal warlord, murderer, rapist, and pedophile from the 7th century. This is blatantly incorrect.
2. Justice Martin allowed Mr. Elbayomy to get away with a violent assault on Mr. Perce. Even if Justice Martin WAS correct about the First Amendment (see above) this would still be no excuse for a violent assault.
3. Justice Martin said that the case was simply one person's word against another, DESPITE the fact that Officer Bryan Curtis (the arresting officer) testified that Mr. Elbayomy admitted to attacking Mr. perce.
4. Justice Martin said that the plaintiff did not prove his accusations beyond a reasonable doubt, and yet REFUSED to allow video evidence that WOULD prove it beyond a reasonable doubt.

Additionally, Justice Martin wrongly took the following into account when delivering his verdict:
1. What the legality and punishment for this incident would have been in Islamic countries. This should be given NO consideration whatsoever in an American court.
2. Accused Mr. Perce of being uneducated when it comes to Islam. This is a false accusation, but more importantly is completely irrelevant to Mr. Perce's First Amendment rights.
3. Gave a rambling, disjointed diatribe full of incomplete thoughts and self-contradictions.

Conclusion:
Justice Mark W Martin should be immediately removed, and a mistrial should be declared.

You Failed the Constitution and the People

Judge Martin,

I am active duty, from what I have read of you, you also served. That to me means that you took an oath, not ust when you became a judge, but also when you decided to serve all Americans by supproting and defending the constitution of the United States against all enemies foreign and domestic. Well your honor (if that should even apply any more) you have broken your oath not once but twice in this ruling. You berated the victim, if you watch the video he was the victim, in this case for not being sympithetic to the fact that the attacker was a muslim and he offended him. Well sir as I have taken the oath to support and defend the constitution and you have greatly offended me and milliions of other veterans who are speaking out about this, on the internet and in friendly discussion. An ignorance of the law does not give one a right to break it. In this case there is beyond a shadow of any doubt that the defendant broke the law and physically assaulted the victim for what he percieved should be law. There are constitutional groups now attempting to decide what action will be taken against your un-lawful, inflamatory, and un-constitutional speach given at the end of the trial. As an Oath Keeper I am a defender of the constitution and a soldier for the people, your transgressions against the people of the United States have not gone without notice, you have become the domestic that we defend constitution from, we have lawyers looking into your abuse of power and the possible charge of violating the defndants first and fourth amendment rights as well as any civil liability that you incur. Be ready for a fight your honor, we come not with physical assault as it would be illegal and un-constitutional, but we come with paperwork and the constitution.

Adjudication at it's worst

Judge Mark W. Martin violated the oath of office he swore to gain the authority he presently has. As far as I'm concerned he permentantly nullified his authority by placing Sharia principles above the Constitution of the United States. He clearly has no objectivity when he adjudicates a case invovling a Muslim. I fear that Mark Martin will continue to allow physical assault and worse solely based on Sharia law. He's unfit to be a judge in America and should make the Middle East his permenant home. I will never recognize his authority and challenge him to prove it!

He upheld a law....just not the American Law.

Upon reading the article regarding Mark Martin, I was frankly stunned at his brashness and lack of objectivity while sitting on the bench. Not only did he fail to properly try this particular case but he also, very clearly, states HIS position on it and why HE, as a Muslim, understands why a fellow muslim did what he did. Without knowing a single thing about this case, hearing what the ""judge"" said, I would immediately understand this judge was extremely biased and clearly pushing an agenda.

I truly hope the people of Mechanicsburg, and Pennsylvania, have the backbone to not stand by idly and ensure Mr. Martin is removed from his position of power. For the record, I would have the same exact opinion on this if it were a Jewish, Christian, Hindi, etc judge who used their faith as a reasoning for their supposedly impartial rendering of the law.

Judge Mark Martin

The case in which Judge Martin dismissed U.S. law in favor of Sharia law shows that Judge Martin should not be in the position he is in.

I am a devout Christian. I am also an American. Judge Martin is also an American, one who has served his country in the military. For that, I appreciate Judge Martin. However, somewhere along the way, Judge Martin has either lost his values as an American or has become so afraid of Islamic backlash that his ability to uphold the laws of the U.S. are skewed by his fear of those he is in charge of judging on U.S. law.

I don't pretend to understand atheists or why the victim of the assault by a Muslim man felt the need to be offensive to religions. By dressing up as zombie pope and zombie Mohamed, atheists felt the need to express their views that people of faith are zombies...ok, that I understand. I don't agree, but I understand.

However, this is the U.S. and not an Islamic nation. Judge Martin had no right to refer to the victim as looking like a doofus, who doesn't look like a doofus dressed up for Halloween? Judge Martin had no right telling the victim that had he dressed the way he did in an Islamic country that he would have been killed. This is the United States of America, not an Islamic country.

However, Judge Martin ruled as if he were ruling in an Islamic country. Judge Martin sent a clear message to American Muslims that it is alright for them to forcibly attack those they believe are being offensive to Islam. This is an attack on the First Amendment of the Constitution that Judge Martin is supposed to be devending and upholding.

In light of Judge Martin's either loss of American values or his cowardness in having to rule against Muslims when they commit a crime, Judge Martin clearly needs to be taken out of the legal system. At the very least, Mark Martin has no right being an U.S. judge.
