Child Custody and Visitation
A common example involves parents who have fallen into drug use or criminal activity and are no longer legally fit parents. In these cases, the child either goes into foster care or is taken in by a relative like an aunt, uncle or grandparent. Once a family member has guardianship of a child and gains child custody, he or she can adopt the child after going through a termination of parental rights proceeding.
Adoption
Stepparent adoption is an option for some families. For example, if the biological parents are divorced, or in some cases where they were never married and the custodial parent has remarried, the custodial parent and his/her spouse can join in a petition for adoption. The non-custodial parent can consent to have his/her parental rights terminated, and the stepparent can proceed with the request to adopt. If the biological parent has not substantially visited or supported the child for six months or more, the court can terminate parental rights in a stepparent adoption proceeding without the non-custodial parent's consent. The non-custodial parent's rights are terminated in a court proceeding, either by consent or by court order if there has been no support or visitation for six months or more.
Guardianship
Guardianship over Minors and Estates. If the parents were killed or are absent and have left behind an estate to the child, then the guardianship would be involved in looking over both the child and the estate. He or she would usually be responsible for the upbringing of the child and for withdrawing payments from the estate as needed for the care and upbringing of the child.

An adult can be granted legal guardianship over a person, an estate or both a person and an estate. There are many different reasons one can have for pursuing guardianship, but all are ultimately rooted in a genuine interest in having someone to watch over, protect and maintain that person or estate. Guardianship over Minor Children. Most guardianships over minor children come about because the parents are, for whatever reason, unable to continue to care for their children. A living will, sometimes known as an advance health care directive, is a legal document in which a person provides instructions for what actions should or should not be taken with respect to their health care or medical care in the event the person becomes unable to make those decisions for themselves due to illness or incapacity. In a living will, a person may provide instructions regarding terminating care and ending life supports in the event he or she becomes terminally ill and on life support.

Revocable Living Trust. Also referred to as a Revocable Trust or Living Trust, this trust is established during the trust maker's life to determine disposition of his/her assets should he/she becomes mentally disabled and upon his/her death. This type of trust is central to most estate plans. During the trust maker's life, the trust maker can be both the trustee and beneficiary of the trust, and therefore have complete control over, and derive all benefits from and pay all taxes on the trust assets during your life. The Living Trust identifies specific trustees and beneficiaries to be automatically designated upon the disability or death of the trust maker.

A Power of Attorney, also known as a Durable Power of Attorney, allows a person to act on your behalf. While you as the principal can decide what powers to give this person, who is known as your "agent" or "attorney-in-fact," in general these powers deal with financial matters such as banking transactions and transactions involving your property.

Foreclosure
The agreement to sell between a real estate buyer and seller is governed by the general principles of contract law. The statute of frauds requires that real property contracts be in writing. Title to real estate must be marketable to be free from liability, which means that it must be free and clear of all encumbrances, liens, clouds, litigation risks or other title defects. To ensure marketable title, the buyer typically employs an attorney or a title insurance company to perform a title search. In a title search, the searcher examines the public records in the county in which a property is located to map a chain of title by examining all the recorded deeds concerning the property. The title searcher will also determine if there are any encumbrances on the property, such as mortgages, unpaid real estate taxes, liens for municipal improvements, unpaid federal taxes, government claims, legal judgments, foreclosures, condemnations, covenants and easements. A title insurance company will insure the buyer against losses caused by the title's invalidity.
