        What is an eviction notice?

        An eviction notice is a legal document that landlords need to serve tenants to begin the process of having them removed the property. There are different kinds of “eviction with cause” notices that require the renter/lessor to stop violating terms of the lease, with removal from the promises as a final measure if they don’t comply. These are issued when rent is overdue, or when a tenant is in violation of a specific term of a lease. Unconditional evictions are the harshest, and usually only appropriate when a tenant is a repeat violator of a clause, or has done something illegal. There is an “eviction notice without cause,” and many states either don’t allow it, or require landlords to give extra notice--up to 60 days--from the point of serving it to the point when the actual eviction suit can begin. Before entering into an agreement, research the laws in your state.

        What happens if rent is not paid on time?

        If rent is not paid on time, a variety of things can happen. Sometimes a late fee will be assessed—this will be stipulated in the lease agreement. More commonly, there will be a written warning or even a few-day grace period -- especially if it’s a first-time infringement or if the rent is collected by an individual landlord rather than a management company, If rent goes unpaid for 14 days when there is no lease, the landlord will generally evict. If there is a lease, the landlord will often begin eviction proceedings at 30 days, unless a late payment arrangement has been reached. The more often someone is late with the rent, , the quicker and harsher  the landlord’s actions are liable to be. A record of late payment can also negatively impact someone’s ability to get approved for future leases.

        What type of maintenance is a renter responsible for?

        A renter is usually only responsible for maintenance necessitated by abuse or neglect of the property. Landlord/building management is usually responsible for the rest. However, cosmetic repairs, such as changing light bulbs or washing carpets, is usually left up to the tenant. And even though a landlord might be financially responsible for other maintenance, it’s often left up to the tenant to coordinate and supervise.

        What is a sublet?

        A sublet is when a person who is leasing an apartment  re-rents to another party. The legalities of this are very tricky, and many landlords/managers outright disallow it on the lease document. However, in situations where there’s an established lease-holder who needs to leave for a predetermined length of time, there are legal procedures to sub-lease. Not all landlords might consent, even if the primary lease holder applies in writing and follows legal procedure. It is very important that, when considering a sublet, you understand the situation between the owner and the lease-holder, because in a hostile sub-lease situation, the sub-leaser risks losing the money they paid in rent to the primary lease-holder.

        Why do some rentals require first and last month rent upfront?

        Some rentals require first and last month rent, because it offers the owner/landlord/building manager a feeling of security that, even in the unforeseen circumstance that the renter/lease holder stops paying the rent, the owner can still be sure to get their rent for one month.

        What is a security deposit?

        A security deposit is the money that a landlord or management company takes from a tenant and holds onto in a special account until the tenant vacates the unit. This money serves as the landlord/manager’s financial protection in case the tenant does not pay rent or causes damage to the unit. The standard amount is equal to one months’ rent, although it can be more in certain housing markets.

        What is the difference between a lease and rental?

        A rental is month-to-month, and the terms can be changed every 30 days. A lease is for a set period of time, and, during that time, the terms can’t be changed, nor the rent raised. Tenants that break a lease will be held responsible for paying rent until they or the landlord can find a new tenant.

        What are some things to consider when renting an apartment?

        There are many things to consider when renting an apartment: Is there available parking? What is the building security? Are there  any building amenities? What are the terms of the lease? Can you have a pet?Is a parking spot included?Are utilities like water and electricity included? As for the apartment itself, make sure you know exactly what appliances and systems it has, including a refrigerator/freezer, dishwasher, and central air conditioning. Are there laundry facilities, and if so, where? State laws are all different in terms of what heating and air conditioning systems are required in rental units. It is important to find out what HVAC systems are in your apartment, if any, whether the renter is expected to pay for them, and whether it’s OK to install your own if they’re not in the unit.

        This place sucks my apartment floods everytime it rains and the staff here has done nothing about it this place is crap been here 2 years and these ppl will not fix anything my fridge was leaking and maintenance said it was condisation lol it was not i fixed it my self anyway dont move here they are raising rent amd still not worth the pay

        I have only once requested a repair to be done at my apartment and it was with regarding our dishwasher. They came right away, it was so convenient.

        I moved in by July of 2015. At the time of the moving, the apartment they gave me came with a defective AC System which needed two loads of Freon gas to start cooling down and a not accurate thermostat that was replaced three times to make it reliable. I had to stand in this situation for 2 weeks before maintenance solved the issue. A dangerous outstanding screw, popping out of one of the apartment walls (somebody in maintenance, instead of cutting it off decided to paint it to camouflage it) hurt my back when moving the furniture in. The front door had a lock that opened from inside only if the key was inserted, making it difficult to evacuate quickly in case of emergency. The back door downstairs area were infested with alive annoying wasps and their nests. The refrigerator's door was out of axle and had a considerable space between in which the cold leaked. Alive roaches and ants were found in the move in cleaning session. Electrical outlets and light sockets needing replacement. ALL OF THIS AT THE TIME I MOVED IN. It was evident that the apartment was not ready, even though they have notice of my moving 60 days prior the moving date.I escalated it to corporate, Insula Companies in Sarasota. Even there the management is the worst I ever have the chance to deal with. They put in the contract to communicate with local and regional management only in writing and when I started doing it, they answer back saying that I should communicate these issues to local management verbally. It looks that nobody knows how to do a decent job in this apartment complex management.

        I have been living here at Carlton Arms for about 6 years now and everything is going great. They are very good about keeping the complex nice and clean and the hallways of the apartments are always well taken care of as well. I have loved living here and I dont see any reason to leave.

        Horrible place to live. Don't be drawn by the great surroundings. This place is poorly managed by two ladies who don't know the word Customer service. You definitely deserve better for the price. Poor maintenance, no preventative maintenance and bug infested. If you like bugs living with you then you'll love this one. If not, don't get into something that apparently is expensive to get out of. They nearly poisoned my dog with careless extermination treatments and didn't care. Oh well, gate never works yet they market the property as a gated community.

        Worst place to live in Lakeland! The apartments look nothing like the pictures or the show model. When we moved in the toilet flood the entire apartment and the refrigerator was full of rotten food. They didn't even bother to sweep up the place. We had to fight to get the bathrooms remodeled (and call in code enforcement to cite them) because the fixtures were busted and instead of cleaning the tub, they just painted over it causing the mold to constantly bleed through. They use paint to fix EVERYTHING! Dirty wall, part over it! Mold and mildew, paint it. Broken cabinet door, paint it (the cabinet door finally gave and broke my toe while I was brushing my teeth). We went 2 weeks without AC and got a window unit to hold us over until they could get around to fixing it. The flooring is not properly fixed to the floor, so you end up stepping on carpet tack strips and tripping over peeling vinyl flooring. Maintenance is a joke and the office staff are rude and unhelpful. We have battled bed bugs twice (we were told to just not use the electrical outlets and to tape them up to prevent future infestation) and now we have rats! To make matters worse, the kitchen cabinets are not rotting! We are trying to move out, but the staff is bad mouthing us to other landlords and is now demanding a rent increase! Run as fast as you can from this property!

        I would say we are happy tenants at Carlton Arms South Lakeland. We are currently leasing an apartment and we plan to renew our lease. We are very satisfied with everything we have here.
