Eminent Domain
Adam M. Henry is the firm’s Managing Partner who practices primarily in the areas of general business law and commercial real estate, including entity formation, transactional matters, development, zoning and land use. His clients include small to medium-sized businesses and financial institutions. He also handles commercial and construction litigation for his business and municipal clients. Trusts and Estates

Estate Planning
It is never too early or too late to do financial and estate planning. It is true that the earlier you start the more options are available to you, but even when you get a later start, there is still very effective planning that can be done and wonderful savings achieved. Medicare, supplemental medical insurance, or Medicaid, could cover medical expenses like home health care, assisted living, or nursing home costs. Medicaid can be available for people still at home if they meet certain qualification requirements. Moreover, Medicaid is available for people in the event they need to go into a long-term care facility. There is a lot of planning to be done when one person needs to go into a nursing home leaving a “community spouse” still at home. Relying on the spousal impoverishment provisions of the Medicaid laws can save sometimes all or almost all of a couple’s assets. No matter when you start planning, it is important to speak to an Elder Law attorney qualified in doing Medicaid Estate Planning.

Heidi is a partner whose legal practice is focused in the areas of Estate Planning and Elder Law. She is certified as an Estate Planning & Administration Specialist by the Indiana State Bar Estate Planning and Administration Specialty Certification Board. William J. Stockdale is an associate in the firm’s Warsaw office who practices primarily in the areas of estate planning, estate and trust administration, asset protection, and long-term nursing home care planning. Power of Attorney
In recent years, more attention has been given to the threat of senior financial exploitation. Unfortunately, it is all too frequent that caregivers and persons acting under a financial power of attorney for a senior use their positions of influence and power to take the senior’s money for their own benefit. Financial professionals may be the first to notice suspicious patterns of unusual activity on a client’s account, like atypical withdrawals or a sudden interest in risky assets that do not track with the client’s previous investing policies. In the past, such professionals hesitated to take action out of concern about being held liable in court for what could be viewed as a client’s privacy. In 2018 Congress responded with the Senior Safe Act. This Act strengthens consumer protections by making it easier for banks, credit unions, insurance agents, financial advisors, brokers, and firms to report suspected incidents of senior financial exploitation to authorities. The Act shields these financial firms and advisors from hostile actions if they report instances of exploitation to law enforcement agencies or adult protective services. The law encourages the training of employees to make reports of suspected financial exploitation.
