DUI/DWI
Generally Hawaii law recognizes claims against drunk drivers for the damages they cause. The Hawaii courts sometimes even impose liability on the sellers of liquor for the damages that drunk drivers cause (dramshop liability).
Wrongful Death
There is nothing in the law that requires you to hire a lawyer to represent you in your claim for damages arising from your brain injury, car accident, spinal cord injury, products liability, wrongful death, truck/bus accident, auto-automobile accident, motorcycle accident, dog bite claim, construction accident, malpractice claim or other liability claim in Hawaii.
Traffic Violations
Failing To Secure Individual Recollections. Normally, to expedite the securing of witness statements, everyone with information relating to an event is collected in a room while each is interviewed. While this facilitates the data collection aspect, it means that during the wait for their turn, people will talk to each other about what happened. As noted above, it has been found that others’ recollections have a profound influence—conscious or unconscious—on witness memories. Alternatively, again in the interests of speeding up the data collection process, an investigator might initially conduct group interviews, followed by focusing on particular individuals identified with special insight or particularly advantageous involvement.
Hit and Run
An insurance agent or company selling auto insurance must also advise a purchaser about uninsured and underinsured motorist coverage options. These may be declined in writing. These may be purchased at a minimum $20,000 per person uninsured motorist coverage to pay for serious injury or death of an insured under the policy with the coverage (or a resident family member), if the driver at fault does not have insurance or in case of a hit and run accident. One may also purchase a minimum $20,000 per person underinsured motorist coverage to pay for the losses of an insured under the policy (or a resident family member) the driver at fault does not have enough insurance. Hawaii Personal Injury Attorney - Auto recommends that these coverages always be accepted. An insurance company or insurance agent can help you decide on the best coverages for your individual situation and needs- but it should be noted that UM and UIM coverages are an important coverage which a policyholder buys to protect his/her own family.

As was noted above, the appropriate level of detail will vary from thin to thick. This same range needs to also be reflected in the forms. Organizations should have several types of forms, reflecting a variety in the extent of information required. This form variety should parallel the event severity. For example, “minor property damage only incidents” or first aid cases can generally be satisfied with thin, or less detailed, investigations. Medical Malpractice
The date when the plaintiff knew or should have known of the negligence of the medical care provider and that injuries resulted therefrom. It is sufficient to start the running of the 2 year (or 6 month) period, if the injured parties have knowledge of the facts which establish an actionable claim. Buck v. Miles, Hawaii Sup. Ct. No. 20368 (Jan. 25, 1999). Some statutes appear to indicate that there is also a maximum limit of six (6) years from the date of the alleged negligence in which to file a medical malpractice claim. You must file your claims in court prior to the expiration of such deadlines, or your claims may be lost—regardless of their merit. Claims arising out of an animal attack and/or dog bites are generally subject to a two-year statute of limitations in Hawaii.
