DUI/DWI
When you have been arrested for DUI, you become immediately aware that this type of arrest is in the total discretion of a police officer. If the police officer “thinks” you are driving and impaired, then the officer will most likely arrest you. This extremely subjective opinion by the officer is what makes DUI arrests so frustrating. Officers administer “roadside sobriety tests” that many times can not be performed by a completely sober person inside in a room, never mind on the side of a roadway.

For an individual to be convicted of first degree murder, which is the most serious of all murder charges, the prosecutor must establish a basis for premeditation; such as the steps that the defendant design or plan out the murder. Felony murder is when the defendant kills an individual while committing, or attempting to commit a felony; burglary, home invasion robbery, various sex crimes, and kidnapping are all examples of felonies that will mandate a first-degree murder charge in the State of Florida. In these cases, the prosecutor must only show that the individual had intent to commit the felony to convict of first-degree murder; someone can be charged at the first-degree if they participated in a crime that lead up to the homicide, even if they did not personally kill.
Fraud
Fraud is a broad term that applies to various federal offenses whereby a defendant intentionally deceives another person for the purpose of providing a benefit to oneself or another person. Different federal laws are in place to penalize specific types of fraud, including mail, wire, and tax fraud, securities fraud, organized fraud, credit card fraud, insider trading, forgery, and healthcare fraud, among others. Although fraud is often thought of as a white collar crime, the term does not only apply to executives stealing large amounts of money from large companies. Theft by false pretense, for example, can be argued to be the most general form of the criminal offense; this occurs when the suspect intentionally deceives a victim through a false representation, tricking the victim into handing over their money or property with the expectation of something in return. Computer crimes often involve fraudulent activities, particularly c omputer hacking. Another example of what may fall under this broad definition: i t is a federal offense to falsely claim to have been awarded any medal by Congress or the Armed forces of the United States.

The past few decades have introduced new elements to white collar crimes – specifically, computers and the internet. In prior years most white collar crimes involved a paper trail, but now we also see computer hard drive records and internet browser history coming into play. Email scams, internet “phishing”, and computer viruses can all fall under the category of white collar crime. These more modern elements can provide a level of anonymity for some white collar criminals, but they can be equally damaging as evidence against the person charged.

The federal government defines a Felony as a crime that if convicted, is punishable by imprisonment of one year or up to a sentence of life in prison or death. White collar crime generally refers to offenses such as embezzlement, identity theft, insider trading, bribery, forgery, and computer/internet criminal acts. Fraudulent activities like Ponzi schemes and Pyramid schemes also fall under the category of white collar crimes. Other forms of white collar crimes can include bank fraud, money laundering, extortion, and tax evasion.

With an estimated 11.5 million actively using marijuana in the United States, it is considered one of the most widely abused, and readily available illegal drugs in the United States. Although there have been a few states recently legalizing marijuana for personal use, it is still considered a federal crime. Those legalized states protect citizens from receiving possession or paraphernalia charges in regards to personal use, but drug trafficking is still a crime. For the past 50 years, marijuana originating in Mexico has been the most widely available. Recently, highly potent strains of the drug have been crossing the Canadian border; and it is also suggested that domestically grown marijuana has been increasing in availability at a high rate. According to the Domestic Cannabis Eradication/Suppression Program, the five leading states for indoor domestic marijuana growth are California, Florida, Oregon, Washington, and Wisconsin. Most outdoor domestic cultivation of marijuana takes place in California, Hawaii, Kentucky, and Tennessee. The DEA seized 4,395,240 marijuana plants being grown domestically, in 2013.
