Child Support
You may have significant differences with your spouse about where your children will live (physical custody), who will make major decisions affecting them (legal custody), and how their financial needs will be met (child support). Child Custody and Visitation
There are four main areas that you should discuss with your attorney: dividing property and debts ( Equitable Distribution ), spousal support ( post-separation support and alimony ), and, if children are involved, child custody and child support. You may need to address short-term financial issues like payment of joint debt, and covering expenses in two households, and making sure children’s support and emotional needs are met. You may want help deciding who will remain in the marital home.
Premarital Agreement
Engaged couples who have adult children, who want to protect certain kinds of assets brought to the marriage, or who want to maintain control over their assets in the event of separation and the distribution of their estates at death may decide that they need a Prenuptial Agreement. A useful and effective Prenuptial Agreement requires careful planning and clear thinking about your goals and values. It can be difficult to have an open and honest discussion about protecting and separating assets in the midst of planning for a wedding and a future life together. For these reasons, negotiating and preparing prenuptial agreements requires sensitivity, thoughtfulness, and care. Many people make the mistake of delaying discussions about a Prenuptial
Spousal Support
Separation and divorce create cash flow problems for most couples. It costs more to support two households than one, and for many of our clients, making ends meet is foremost on their minds. If one spouse earns significantly more than the other, and the spouse with the lower income cannot cover his or her expenses with the income he or she earns, post-separation support or alimony may be appropriate.
