Landlord-Tenant Disputes
In North Carolina, the rights of landlord and the rights of tenants are dictated by the terms of the lease agreement and Article 42 of the North Carolina General Statutes. For residential tenants, there are many rights spelled out in the law to protect them from slum lords and unlawful failure to return a security deposit. Conversely, landlords have rights as well in residential situations. A landlord may have the right to remove a tenant if that tenant is committing a crime or doing drugs in an expedited fashion or simply evict a tenant for nonpayment. For commercial leases, however, the terms are controlling and there are not many landlord tenant laws specifically stated to assist as it is generally presumed that commercial or business landlords and tenants have the ability to contract the way they feel best for their situation.
